1 1 Section 1. NEW SECTION. 135.12 HEALTH CARE PROVIDER
1 2 RECORDS &endash; CERTIFIED DUPLICATES &endash; FEES.
1 3 The Iowa department of public health shall adopt rules
1 4 prescribing uniform fees, based upon the actual cost of
1 5 duplication, that a health care provider may charge for
1 6 certified duplicate health care records requested by an
1 7 attorney to be admitted as evidence at a trial or hearing. As
1 8 used in this section, "health care provider" means a person
1 9 licensed to practice a profession pursuant to chapter 147, a
1 10 hospital licensed pursuant to chapter 135B, or a health care
1 11 facility licensed pursuant to chapter 135C. The rules adopted
1 12 may provide for an additional fee based upon the actual costs
1 13 for postage or other means of delivery and may provide for an
1 14 annual increase based upon the annual rate of inflation for
1 15 the preceding calendar year as determined by the consumer
1 16 price index published by the bureau of labor statistics of the
1 17 United States department of labor.
1 18 EXPLANATION
1 19 This bill directs the Iowa department of public health to
1 20 adopt rules prescribing uniform fees to be charged attorneys
1 21 for the duplication of health care provider records.
