  1  1    Section 1.  Section 257.4, Code 1995, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  1A.  SUPPLEMENTAL AID FOR 1995-1996.
  1  4 However, for the budget year beginning July 1, 1995, if the
  1  5 rate of the additional property tax levy determined under
  1  6 subsection 1 for the budget year exceeds the rate that would
  1  7 have been determined for the budget year if the state percent
  1  8 of growth for the budget year was established at three percent
  1  9 instead of at four and two-tenths percent, the department of
  1 10 management shall reduce the rate of the additional property
  1 11 tax levy by the amount of the excess.  The department shall
  1 12 include in state aid payments made to the school district
  1 13 under section 257.16 during the budget year the amount of the
  1 14 reduction in property tax revenues made under this subsection.
  1 15 Moneys received by a school district under this subsection
  1 16 shall be considered revenues generated from the additional
  1 17 property tax under this section.
  1 18    Sec. 2.  Section 257.14, unnumbered paragraph 1, Code 1995,
  1 19 is amended to read as follows:
  1 20    For the budget years commencing July 1, 1991, July 1, 1992,
  1 21 July 1, 1993, July 1, 1994, and July 1, 1995, if the
  1 22 department of management determines that the regular program
  1 23 district cost of a school district for a budget year is less
  1 24 than one hundred percent, or for the budget year beginning
  1 25 July 1, 1995, less than one hundred one percent, of the total
  1 26 of the regular program district cost plus any adjustment added
  1 27 under this section for the base year for that school district,
  1 28 the department of management shall provide a budget adjustment
  1 29 for that district for that budget year that is equal to the
  1 30 difference.  For the budget year commencing July 1, 1995,
  1 31 there is appropriated from the general fund of the state to
  1 32 the department of education an amount sufficient to pay, as
  1 33 state supplementary aid, to those school districts the
  1 34 additional adjustment amounts added to their budgets as a
  1 35 result of increasing from a one hundred percent budget
  2  1 guarantee to a one hundred one percent budget guarantee.
  2  2    Sec. 3.  Section 257.16, unnumbered paragraph 1, Code 1995,
  2  3 is amended to read as follows:
  2  4    There is appropriated each year from the general fund of
  2  5 the state an amount necessary to pay the foundation aid and
  2  6 supplementary aid under section 257.4, subsection subsections
  2  7 1A and 2.
  2  8    Sec. 4.  This Act, being deemed of immediate importance,
  2  9 takes effect upon enactment and applies to the school budget
  2 10 year beginning July 1, 1995.  
  2 11                           EXPLANATION
  2 12    The bill requires the state to pay to each school district
  2 13 the amount of the additional property tax a school district
  2 14 would need to raise because of the state percent of growth
  2 15 being set at 4.2 percent instead of 3.0 percent.
  2 16    Present law guarantees that a school district's regular
  2 17 program district costs for the budget year beginning July 1,
  2 18 1995, will equal at least 100 percent of those district costs
  2 19 plus any cost guarantee adjustment for the previous school
  2 20 budget years.  This bill increases that guarantee from 100
  2 21 percent to 101 percent for the budget year beginning July 1,
  2 22 1995.  The bill makes appropriations from the state general
  2 23 fund to pay school districts the amounts by which their
  2 24 additional property tax revenues are reduced and by which
  2 25 their budgets increased because of the guarantee being changed
  2 26 from 100 percent to 101 percent.
  2 27    The bill takes effect upon enactment.
