1 1 Section 1. Section 455B.173, Code 1995, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 12. Adopt rules for the issuance of a
1 4 single general permit, after notice and opportunity for a
1 5 public hearing. The single general permit shall cover
1 6 numerous facilities to the extent that they are representative
1 7 of a class of facilities which can be identified and
1 8 conditioned by a single permit.
1 9 Sec. 2. Section 455B.304, Code 1995, is amended by adding
1 10 the following new subsection:
1 11 NEW SUBSECTION. 19. The commission shall adopt rules for
1 12 the issuance of a single general permit, after notice and
1 13 opportunity for a public hearing. The single general permit
1 14 shall cover numerous facilities to the extent that they are
1 15 representative of a class of facilities which can be
1 16 identified and conditioned by a single permit.
1 17 Sec. 3. EFFECTIVE DATE. This Act, being deemed of
1 18 immediate importance, takes effect upon enactment.
1 19 EXPLANATION
1 20 This bill amends chapter 455B which provides for
1 21 environmental regulations. The bill amends provisions in the
1 22 chapter regulating water quality and solid waste disposal, by
1 23 requiring the environmental protection commission to adopt
1 24 rules for the issuance of a single general permit. The permit
1 25 is required to cover numerous facilities to the extent that
1 26 they represent a class of facilities which can be identified
1 27 and conditioned by a single permit. The bill takes effect
1 28 upon enactment.
