PAG LIN 1 1 Section 1. Section 235B.6, subsection 2, paragraph b, Code 1 2 1995, is amended to read as follows: 1 3 b. A person involved in an investigation of dependent 1 4 adult abuse including all of the following: 1 5 (1) A health practitioner or mental health professional 1 6 who is examining, attending, or treating an adult whom such 1 7 practitioner or professional believes or has reason to believe 1 8 has been the victim of abuse or to a health practitioner or 1 9 mental health professional whose consultation with respect to 1 10 an adult believed to have been the victim of abuse is 1 11 requested by the department. 1 12 (2) An employee or agent of the department responsible for 1 13 the investigation of a dependent adult abuse report. 1 14 (3) A representative of the department involved in the 1 15 certification or accreditation of an agency or program 1 16 providing care or services to a dependent adult believed to 1 17 have been a victim of abuse. 1 18(3)(4) A law enforcement officer responsible for 1 19 assisting in an investigation of a dependent adult abuse 1 20 allegation. 1 21(4)(5) A multidisciplinary team, if the department of 1 22 human services approves the composition of the 1 23 multidisciplinary team and determines that access to the team 1 24 is necessary to assist the department in the investigation, 1 25 diagnosis, assessment, and disposition of a case of dependent 1 26 adult abuse. 1 27(5)(6) The mandatory reporter who reported the dependent 1 28 adult abuse in an individual case. 1 29 EXPLANATION 1 30 This bill adds to the list of persons with access to 1 31 dependent adult abuse information, those who are involved in 1 32 an investigation of dependent adult abuse and who are 1 33 department representatives involved with the certification or 1 34 accreditation of an agency or program providing care or 1 35 services to a dependent adult believed to have been a victim 2 1 of abuse. 2 2 BACKGROUND STATEMENT 2 3 SUBMITTED BY THE AGENCY 2 4 Iowa Code section 235B.6, subsection 2, paragraph "b", 2 5 describes individuals, agencies, and other entities in the 2 6 investigation of a report of dependent adult abuse who are 2 7 authorized access to adult abuse investigation information and 2 8 reports. The department of human services proposes adding 2 9 department representatives involved with the certification or 2 10 accreditation of agencies or programs to the list. Situations 2 11 arise when department staff performing quality assurance 2 12 activity are investigating the same situation or situations 2 13 being investigated by adult abuse staff. It is important that 2 14 there be free exchange of information among these personnel. 2 15 Current Code language does not specifically allow for this 2 16 exchange. 2 17 LSB 1296DP 76 2 18 pf/sc/14.1
