1 1 Section 1. Section 607A.45, subsection 1, Code 1995, is
1 2 amended to read as follows:
1 3 1. An employer or a person acting on behalf of an employer
1 4 shall not deprive an employee of employment or threaten or
1 5 otherwise coerce an employee with respect to the employee's
1 6 employment or employment benefits or impose a penalty
1 7 regarding the employee's employment or employment benefits
1 8 because the employee receives a notice to report, responds to
1 9 the notice, serves as a juror, or attends court for
1 10 prospective juror service. An employer who violates this
1 11 subsection commits contempt.
1 12 An employer who pays the employee the employee's regular
1 13 pay while the employee is on jury duty may reduce the pay of
1 14 an employee by an amount equal to the fee paid jurors under
1 15 section 607A.8 for jury duty. Expenses reimbursed to jurors
1 16 shall not be deducted by the employer.
1 17 EXPLANATION
1 18 This bill provides that an employer or person acting on
1 19 behalf of the employer cannot deprive the employee of, or
1 20 threaten an employee with, discharge, loss of benefits, or
1 21 penalize the employee on account of the employee's absence
1 22 from employment for jury duty. The bill also provides that an
1 23 employer may deduct the fee paid to the employee as a juror
1 24 from the employee's pay but not expenses reimbursed to the
1 25 employee for jury duty.
