1 1 Section 1. NEW SECTION. 331.909 MULTIDISCIPLINARY
1 2 COMMUNITY SERVICES TEAMS.
1 3 1. A county or multicounty consortium of agencies
1 4 providing health, counseling, economic assistance, education,
1 5 law enforcement, or therapeutic services may establish a
1 6 multidisciplinary team for the more effective planning and
1 7 delivery of services to an individual or family under the
1 8 following conditions:
1 9 a. The team complies with federal regulations regarding
1 10 confidentiality.
1 11 b. The agencies comprising the team have written
1 12 confidentiality standards.
1 13 c. The agencies comprising the team enter into an annual
1 14 interagency agreement to comply with confidentiality standards
1 15 specified in the agreement.
1 16 d. An agency initiating a multidisciplinary team obtains a
1 17 signed agreement from an individual authorizing the team to
1 18 share information concerning the individual or the
1 19 individual's family on a confidential basis.
1 20 2. The activities of a multidisciplinary community
1 21 services team shall not duplicate the activities of a
1 22 multidisciplinary team for child abuse under section 235A.13,
1 23 dependent adult abuse activities under section 235B.6, area
1 24 education agency activities under section 294A.14, or child
1 25 victim services provided under section 910A.16.
1 26 3. A multidisciplinary community services team shall
1 27 select a chairperson and other officers as deemed necessary by
1 28 the members of the team. A multidisciplinary community
1 29 services team is not a governmental body as defined in section
1 30 21.2 and is not subject to the provisions of chapter 21,
1 31 relating to open meetings. Notwithstanding chapter 22, the
1 32 confidentiality of information in the possession of a
1 33 multidisciplinary team which is required by law to be
1 34 confidential shall be maintained except as specifically
1 35 provided by this section.
2 1 4. The members of a multidisciplinary community services
2 2 team are expressly authorized to orally disclose personally
2 3 identifying information to one another which is otherwise
2 4 required by law to be confidential. Disclosure of
2 5 confidential information other than oral information between
2 6 team members under provisions of this section is expressly
2 7 prohibited.
2 8 5. A member of a multidisciplinary community services team
2 9 shall not use confidential information obtained from another
2 10 team member except in the best interests of the subject of the
2 11 confidential information and shall not disclose such
2 12 information to another person except as otherwise authorized
2 13 by law. A member of a multidisciplinary community services
2 14 team who willfully uses or discloses confidential information
2 15 in violation of this section commits a serious misdemeanor.
2 16 Notwithstanding section 903.1, the penalty for a person
2 17 convicted pursuant to this subsection is a fine of not more
2 18 than five hundred dollars in the case of a first offense and
2 19 not more than five thousand dollars in the case of each
2 20 subsequent offense.
