PAG LIN 1 1 Section 1. Section 256.16, Code 1995, is amended to read 1 2 as follows: 1 3 256.16 SPECIFIC CRITERIA FOR TEACHER PREPARATION AND 1 4 CERTAIN EDUCATORS. 1 5 1. Pursuant to section 256.7, subsection 5, the state 1 6 board shall adopt rules requiring all higher education 1 7 institutions providing practitioner preparation to include in 1 8 the professional education program, preparation that 1 9 contributes to education ofthe handicappedchildren with 1 10 disabilities and the gifted and talented, which must be 1 11 successfully completed before graduation from the practitioner 1 12 preparation program. Preparation that contributes to 1 13 education of students with disabilities, under this section, 1 14 shall include, but is not limited to, the following: 1 15 a. Instruction in the laws impacting the education of 1 16 children with disabilities, including section 504 of the 1 17 federal Rehabilitation Act of 1973, the federal Americans with 1 18 Disabilities Act of 1991, and the federal Individuals with 1 19 Disabilities Education Act. 1 20 b. Knowledge about, and teaching methods to respond to, 1 21 the learning styles of these children and particular 1 22 challenges and barriers affecting the education of children 1 23 with disabilities. 1 24 c. Information about resources available to facilitate the 1 25 education of children with disabilities in the regular 1 26 classroom, including but not limited to using resources such 1 27 as other students, parents, and government and community 1 28 agencies. 1 29 d. Knowledge of assistive technology and other available 1 30 accommodations for children with disabilities. 1 31 2. A person initially applying for a license shall 1 32 successfully complete a professional education program 1 33 containing the subject matter specified in this section, 1 34 before the initial action by the board of educational 1 35 examiners takes place. 2 1 EXPLANATION 2 2 This bill increases the information that institutions of 2 3 higher education must include in practitioner preparation 2 4 programs which contributes to the education of children with 2 5 disabilities. 2 6 Currently, the state board must adopt rules requiring all 2 7 higher education institutions providing practitioner 2 8 preparation programs to include preparation that contributes 2 9 to the education of the handicapped. The bill updates the 2 10 term "the handicapped" with the term "children with 2 11 disabilities". 2 12 The bill adds the following to the preparation that must be 2 13 included in the professional education program: (1) 2 14 instruction in the laws impacting the education of students 2 15 with disabilities, including section 504 of the federal 2 16 Rehabilitation Act of 1973, the federal Americans with 2 17 Disabilities Act of 1991, and the federal Individuals With 2 18 Disabilities Education Act; (2) knowledge about, and teaching 2 19 methods to respond to, the learning styles of these children 2 20 and particular challenges and barriers affecting the education 2 21 of persons with disabilities; (3) information about resources 2 22 available to facilitate the education of persons with 2 23 disabilities in the regular classroom, including but not 2 24 limited to using other students, parents, and government and 2 25 community agencies as resources; and (4) knowledge of 2 26 assistive technology and other available accommodations for 2 27 persons with disabilities. 2 28 LSB 4076XS 76 2 29 kh/jw/5
