1 1 Section 1. Section 282.31, subsection 1, paragraph b,
1 2 unnumbered paragraph 1, Code Supplement 1995, is amended by
1 3 striking the unnumbered paragraph and inserting in lieu
1 4 thereof the following:
1 5 If a child lives in a facility or home pursuant to section
1 6 282.19, and is enrolled in an educational program of the
1 7 district in which the facility or home is located, the costs
1 8 of the educational program shall be paid by the district of
1 9 residence of the child to the school district in which the
1 10 facility or home is located, if all of the following criteria
1 11 are met:
1 12 (1) The child does not require special education.
1 13 (2) The child is not enrolled in the educational program
1 14 of the district of residence of the child.
1 15 (3) The child is not included in the budget enrollment for
1 16 the budget year beginning July 1, 1997, of the school district
1 17 in which the facility or home is located.
1 18 Sec. 2. This Act takes effect January 1, 1997, and applies
1 19 to budget years beginning on or after July 1, 1997.
1 20 EXPLANATION
1 21 The bill provides that a child living in a licensed child
1 22 foster care facility or a facility involving substance abusers
1 23 who does not require special education and is not enrolled in
1 24 the educational program of the district of residence of the
1 25 child or included in the budget enrollment of the school
1 26 district in which the facility is located for the budget year
1 27 beginning July 1, 1997, but who is enrolled in an educational
1 28 program of the district in which the facility is located, will
1 29 have the cost of the education paid for by the school district
1 30 of residence, which is the school district in which the parent
1 31 or legal guardian of the child resides. Present law includes
1 32 the child in the basic enrollment of the school district where
1 33 the facility is located.
1 34 The bill contains an effective date of January 1, 1997, and
1 35 is made applicable to budget years beginning on or after July
2 1 1, 1997.
