  1  1    Section 1.  Section 321.285, subsection 6, Code 1995, is
  1  2 amended to read as follows:
  1  3    6.  Notwithstanding any other speed restrictions, the speed
  1  4 limit for all vehicular traffic on fully controlled-access,
  1  5 divided, multilaned highways including the national system of
  1  6 interstate highways designated by the federal highway
  1  7 administration and this state (23 U.S.C.  } 103 (e)) is sixty-
  1  8 five miles per hour.  The department may establish a speed
  1  9 limit of sixty-five miles per hour on certain divided,
  1 10 multilaned highways.  However, the department or cities with
  1 11 the approval of the department may establish a lower speed
  1 12 limit upon such highways located within the corporate limits
  1 13 of a city.  For the purposes of this subsection a fully
  1 14 controlled-access highway is a highway that gives preference
  1 15 to through traffic by providing access connections with
  1 16 selected public roads only and by prohibiting crossings at
  1 17 grade or direct private driveway connections.  A minimum speed
  1 18 of forty miles per hour, road conditions permitting, is
  1 19 established on the highways referred to in this subsection.
  1 20    It is further provided that any kind of vehicle, implement,
  1 21 or conveyance incapable of attaining and maintaining a speed
  1 22 of forty miles per hour shall be prohibited from using the
  1 23 interstate system.
  1 24    Sec. 2.  CONSTRUCTION AREA SAFETY STUDY.  The state
  1 25 department of transportation and the department of public
  1 26 safety shall study and prepare a joint report relating to
  1 27 vehicle speed management, enhanced speed limit enforcement,
  1 28 and work zone safety in construction areas.  The departments
  1 29 shall confer with representatives of the private sector
  1 30 construction industry to develop guidelines to promote
  1 31 motorist and construction worker safety.  The departments
  1 32 shall file the joint report with the general assembly by
  1 33 January 1, 1997.
  1 34    Sec. 3.  EFFECTIVE DATE.  This bill being deemed of
  1 35 immediate importance is effective upon enactment.
