1 1 Section 1. NEW SECTION. 455D.14A CHLOROFLUOROCARBON
1 2 FREON IN AIR CONDITIONERS.
1 3 1. As used in this section, "air conditioner" means a
1 4 mechanical device used to cool the air temperature inside a
1 5 building, structure, or motor vehicle.
1 6 2. A person may manufacture the chlorofluorocarbon freon
1 7 solely for the purpose of supplying the operating needs of an
1 8 air conditioner that is owned or possessed and operated by a
1 9 person before January 1, 1996.
1 10 EXPLANATION
1 11 Federal law, codified at 42 U.S.C. } 7671, bans the
1 12 manufacture and importation of chlorofluorocarbons beginning
1 13 January 1, 1996. Federal law will still permit the sale and
1 14 use of chlorofluorocarbons manufactured or imported before
1 15 that date.
1 16 This bill, in contravention of the federal ban as
1 17 interpreted by the United States environmental protection
1 18 agency, permits a person to manufacture the chlorofluorocarbon
1 19 freon solely for the purpose of supplying the operating needs
1 20 of an air conditioner that is owned or possessed and operated
1 21 by a person before January 1, 1996.
