1 1 Section 1. Section 455B.310, Code Supplement 1995, is
1 2 amended by adding the following new subsection:
1 3 NEW SUBSECTION. 8. A county in which a privately operated
1 4 sanitary landfill accepts solid waste from outside of the
1 5 county may charge an additional tonnage fee for the disposal
1 6 of all solid waste at the sanitary landfill. The additional
1 7 fee charged and the moneys collected shall be used exclusively
1 8 by the county for the development and implementation of
1 9 alternatives to sanitary landfills, for the costs incurred by
1 10 the county to abate problems associated with the operation of
1 11 the sanitary landfill, or for inspections of the sanitary
1 12 landfill by the county. Notwithstanding this subsection, the
1 13 county board of supervisors may waive the additional tonnage
1 14 fee for a county, city, or individually contracted industry
1 15 which is located outside of the county if solid waste received
1 16 from the county, city, or individually contracted industry
1 17 accounts for not more than three-tenths of one percent of the
1 18 annual total amount of solid waste disposed of at the sanitary
1 19 landfill.
1 20 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 21 immediate importance, takes effect upon enactment.
