1 1 Section 1. MEDICAL ASSISTANCE WAIVER &endash; ESTATE RECOVERY
1 2 EXEMPTION. The department of human services shall seek a
1 3 waiver from the United States health care financing
1 4 administration to provide that under the state plan for
1 5 medical assistance, the department may exempt from application
1 6 of estate recovery requirements the residence of the recipient
1 7 if the title to the residence is transferred to a child of the
1 8 recipient, and if the individual income of the recipient at
1 9 the time of the recipient's death is $10,000 or less.
1 10 EXPLANATION
1 11 This bill directs the department of human services to seek
1 12 a waiver from the United States health care financing
1 13 administration to provide that under the state plan for
1 14 medical assistance, the state may exempt the residence of a
1 15 recipient from estate recovery if the title to the residence
1 16 is transferred to a child of the recipient, and if the
1 17 individual income of the recipient at the time of death is
1 18 $10,000 or less.
