PAG LIN 1 1 Section 1. Section 235A.15, subsection 2, paragraph c, 1 2 Code 1995, is amended by adding the following new 1 3 subparagraph: 1 4 NEW SUBPARAGRAPH. (11) To an administrator of a facility 1 5 or program operated by the state or a city or county which 1 6 provides services or care directly to children, if the 1 7 information concerns a person employed by or being considered 1 8 for employment by the facility or program. 1 9 Sec. 2. Section 235A.15, subsection 4, unnumbered 1 10 paragraph 1, Code 1995, is amended to read as follows: 1 11 Access to founded child abuse informationonlyis 1 12 authorized to the department of personnel or to the personnel 1 13 office of a public employer, as defined in section 20.3, as 1 14 necessary for presentation in grievance or arbitration 1 15 procedures provided for in sections 19A.14 and 20.18. Child 1 16 abuse information introduced into a grievance or arbitration 1 17 proceeding shall not be considered a part of the public record 1 18 of a case. Access to founded child abuse information under 1 19 this paragraph is limited to the extent the procedure or 1 20 proceeding includes issues relating to child abuse and the 1 21 information requested is relevant to the issues. 1 22 EXPLANATION 1 23 This bill provides for access to founded and undetermined 1 24 child abuse information. Section 235A.15, subsection 2, lists 1 25 entities with authorized access to child abuse information, 1 26 other than unfounded child abuse information, maintained by 1 27 the department of human services. The bill amends these 1 28 provisions to authorize access to an administrator of a 1 29 facility or program operated by the state or a city or county 1 30 which provides services or care directly to children, if the 1 31 information concerns a person employed by or being considered 1 32 for employment by the facility or program. 1 33 Section 235A.15, subsection 4, provides for access to 1 34 founded child abuse information only to the department of 1 35 personnel as necessary for grievance or arbitration procedures 2 1 or proceedings under sections 19A.14 and 20.18. The bill 2 2 extends the access to personnel offices of the state and its 2 3 boards, commissions, departments, and its political 2 4 subdivisions, including school districts and other special 2 5 purpose districts. The access is limited to the extent the 2 6 procedure or proceeding includes issues related to child abuse 2 7 and the information requested is relevant to those issues. 2 8 LSB 2448SS 76 2 9 jp/cf/24
