  1  1    Section 1.  Section 257.10, subsection 7, Code 1995, is
  1  2 amended to read as follows:
  1  3    7.  SPECIAL EDUCATION SUPPORT SERVICES DISTRICT COST.
  1  4 Special education support services district cost for a school
  1  5 district for a budget year is equal to the special education
  1  6 support services district cost per pupil for the budget year
  1  7 multiplied by the special education support services weighted
  1  8 enrollment for the district for the budget year.  If Beginning
  1  9 with the budget year commencing July 1, 1996, if the special
  1 10 education support services district cost for a school district
  1 11 for a budget year is less than one hundred two percent of the
  1 12 special education support services district cost for that
  1 13 district for the base year, the department of management shall
  1 14 adjust the special education support services district cost
  1 15 for that district for the budget year to equal one hundred two
  1 16 percent of the special education support services district
  1 17 cost for the base year.
  1 18    Sec. 2.  Section 257.14, unnumbered paragraph 1, Code 1995,
  1 19 is amended to read as follows:
  1 20    For the budget years commencing July 1, 1991, July 1, 1992,
  1 21 July 1, 1993, July 1, 1994, and July 1, 1995 Beginning with
  1 22 the budget year commencing July 1, 1996, if the department of
  1 23 management determines that the regular program district cost
  1 24 of a school district for a budget year is less than one
  1 25 hundred two percent of the total of the regular program
  1 26 district cost plus any adjustment added under this section for
  1 27 the base year for that school district, the department of
  1 28 management shall provide a budget adjustment for that district
  1 29 for that budget year that is equal to the difference.
  1 30    Sec. 3.  This Act takes effect January 1, 1996, for school
  1 31 budget years commencing after that date.  
  1 32                           EXPLANATION
  1 33    The bill provides under the state school foundation aid
  1 34 program a guarantee to each school district that for a budget
  1 35 year its regular program district cost and its special
  2  1 education support services district cost will each equal at
  2  2 least 102 percent of those district costs for the base year.
  2  3 Present law provides only a 100 percent guarantee but the
  2  4 regular program guarantee will end at the end of the 1995-1996
  2  5 budget year.
  2  6    The bill takes effect January 1, 1996, for budget years
  2  7 commencing after that date.
