PAG LIN 1 1 Section 1. Section 256B.9, subsection 4, Code 1995, is 1 2 amended to read as follows: 1 3 4. On December 1,19871995, and no later than December 1 1 4 every two years thereafter, for the school year commencing the 1 5 following July 1, the director of the department of education 1 6 shall report to the school budget review committee the average 1 7 costs of providing instruction for children requiring special 1 8 education in the categories of the weighting plan established 1 9 under this section, and for providing services to nonpublic 1 10 school students pursuant to section 256.12, subsection 2, and 1 11 the director of the department of education shall make 1 12 recommendations to the school budget review committee for 1 13 needed alterations to make the weighting plan suitable for 1 14 subsequent school years. The school budget review committee 1 15 shall establish the weighting plan for each school year and 1 16 shall report the plan to the director of the department of 1 17 education. The school budget review committee may establish 1 18 weights to the nearest hundredth and the weights shall reflect 1 19 the actual costs of providing instruction for children 1 20 requiring special education. The school budget review 1 21 committee shall not alter the weighting assigned to pupils in 1 22 a regular curriculum, but it may increase or decrease the1 23weighting assigned to each category of children requiring1 24special education by not more than two-tenths of the weighting1 25assigned to pupils in a regular curriculum. The state board 1 26 of education shall adopt rules under chapter 17A to implement 1 27 the weighting plan for each year and to assist in 1 28 identification and proper indexing of each child in the state 1 29 who requires special education. 1 30 EXPLANATION 1 31 This bill allows the school budget review committee to 1 32 establish weights to the nearest hundredth to reflect the 1 33 actual costs of providing instruction for children requiring 1 34 special education.
