PAG LIN 1 1 Section 1. Section 902.7, Code 1995, is amended to read as 1 2 follows: 1 3 902.7 MINIMUM SENTENCE &endash; USE OF AFIREARMDANGEROUS 1 4 WEAPON. 1 5 At the trial of a person charged with participating in a 1 6 forcible felony, if the trier of fact finds beyond a 1 7 reasonable doubt that the person is guilty of a forcible 1 8 felony and that the person represented that the person was in 1 9 the immediate possession and control of afirearmdangerous 1 10 weapon, displayed afirearmdangerous weapon in a threatening 1 11 manner, or was armed with afirearmdangerous weapon while 1 12 participating in the forcible felony the convicted person 1 13 shall serve a minimum of five years of the sentence imposed by 1 14 law. A person sentenced pursuant to this section shall not be 1 15 eligible for parole until the person has served the minimum 1 16 sentence of confinement imposed by this section. 1 17 EXPLANATION 1 18 This bill provides that a person who claims to have a 1 19 dangerous weapon, in the person's possession, displays a 1 20 dangerous weapon in a threatening manner, or actually has a 1 21 dangerous weapon in the person's possession during the 1 22 commission of a forcible felony, shall serve a minimum term in 1 23 prison of five years. 1 24 LSB 1591SV 76 1 25 mk/jj/8
