1 1 Section 1. NEW SECTION. 2.34 CALL OF THE SENATE AND
1 2 HOUSE OF REPRESENTATIVES.
1 3 The rules of the senate and house of representatives shall
1 4 specify procedures for imposing a call of the senate and a
1 5 call of the house of representatives respectively. Upon call,
1 6 the senate or house of representatives shall not recess or
1 7 adjourn until every senator or member of the house of
1 8 representatives is present to vote on the motion under
1 9 consideration or a motion to recess or adjourn to a specific
1 10 time, unless the senator or member is excused as may be
1 11 provided in rules of the senate or the house of
1 12 representatives. The senate or house of representatives may
1 13 compel attendance of senators or members of the house of
1 14 representatives.
1 15 Sec. 2. Section 257.8, subsection 1, Code 1995, is amended
1 16 to read as follows:
1 17 1. STATE PERCENT OF GROWTH. The state percent of growth
1 18 for a budget year shall be established by statute which shall
1 19 be enacted within thirty days of the submission in the base
1 20 year of the governor's budget under section 8.21. However,
1 21 notwithstanding procedures specified for the imposition of a
1 22 call of the senate or house of representatives in the rules of
1 23 procedure of the senate and house of representatives,
1 24 respectively, if, by the thirtieth day, a bill is not passed
1 25 by the general assembly which establishes the state percent of
1 26 growth for a budget year, on the thirtieth day calls of the
1 27 senate and house of representatives are imposed, as provided
1 28 in section 2.34. Notwithstanding that section, the senate and
1 29 the house of representatives shall not recess or adjourn until
1 30 the general assembly passes the bill. The establishment of
1 31 the state percent of growth for a budget year shall be the
1 32 only subject matter of the bill which enacts the state percent
1 33 of growth for a budget year.
1 34 EXPLANATION
1 35 This bill requires that the rules adopted by the senate and
2 1 house of representatives provide for a call of the senate or a
2 2 call of the house of representatives. Upon call, the senate
2 3 or house of representatives is prohibited from recessing or
2 4 adjourning until every senator or member of the house of
2 5 representatives is present to vote on the motion under
2 6 consideration or a motion to recess or adjourn, unless the
2 7 senator or member is excused as may be provided in rules of
2 8 the senate or the house of representatives.
2 9 The bill amends section 257.8, which provides that the
2 10 state percent of growth for state aid to the state school
2 11 foundation must be enacted within 30 days of the submission in
2 12 the base year of the governor's budget. This bill provides
2 13 that if the bill which establishes the state percent of growth
2 14 for a budget year is not passed by the general assembly within
2 15 the 30 days, a call of the senate and house of representatives
2 16 must be made on the thirtieth day. The senate and the house
2 17 of representatives are prohibited from recessing or adjourning
2 18 until the general assembly passes the bill.
