PAG LIN 1 1 Section 1. Section 56.14, Code 1995, is amended to read as 1 2 follows: 1 3 56.14 POLITICAL ADVERTISEMENTS &endash; YARD SIGNS. 1 4 A person who causes the publication or distribution of 1 5 published material designed to promote or defeat the 1 6 nomination or election of a candidate for public office or the 1 7 passage of a constitutional amendment or public measure shall 1 8 include conspicuously on the published material the identity 1 9 and address of the person responsible for the material. If 1 10 the person responsible is an organization, the name of one 1 11 officer of the organization shall appear on the material. 1 12 However, if the organization is a committee which has filed a 1 13 statement of organization under this chapter, only the name of 1 14 the committee is required to be included on the published 1 15 material. This section does not apply to the editorials or 1 16 news articles of a newspaper or magazine which are not 1 17 political advertisements. For the purpose of this section, 1 18 "published material" means any newspaper, magazine, shopper, 1 19 outdoor advertising facility, poster, direct mailing, 1 20 brochure, or any other form of printed general public 1 21 political advertising; however, the identification need not be 1 22 conspicuous on posters. This section does not apply to yard 1 23 signs, bumper stickers, pins, buttons, pens, matchbooks, and 1 24 similar small items upon which the inclusion of the disclaimer 1 25 would be impracticable or to published material which is 1 26 subject to federal regulations regarding a disclaimer 1 27 requirement. Yard signs shall not be placed on any property 1 28 which adjoins a city, county, or state roadway sooner than 1 29forty-fivethirty days preceding a primary or general election 1 30 and shall be removed within seven days after the primary or 1 31 general election, in which the name of the particular 1 32 candidate or ballot issue described on the yard sign appears 1 33 on the ballot. Yard signs are subject to removal by highway 1 34 authorities as provided in section 319.13. The placement or 1 35 erection of yard signs shall be exempt from the requirements 2 1 of chapter 480. Notice may be provided to the chairperson of 2 2 the appropriate county central committee if the highway 2 3 authorities are unable to provide notice to the candidate, 2 4 candidate's committee, or political committee regarding the 2 5 yard sign. This section does not prohibit the placement of 2 6 yard signs on agricultural land owned by individuals or by a 2 7 family farm operation as defined in section 9H.1, subsections 2 8 8, 9, and 10; does not prohibit the placement of yard signs on 2 9 property owned by private individuals who have rented or 2 10 leased the property to a corporation, if the prior written 2 11 permission of the property owner is obtained; and does not 2 12 prohibit the placement of yard signs on residential property 2 13 owned by a corporation but rented or leased to a private 2 14 individual if the prior permission of the renter or lessee is 2 15 obtained. For the purposes of this chapter, "agricultural 2 16 land" means agricultural land as defined in section 9H.1. 2 17 Sec. 2. Section 306C.22, Code 1995, is amended to read as 2 18 follows: 2 19 306C.22 POLITICAL SIGNS. 2 20 It shall be lawful to place political signs on private 2 21 property with permission of the owner or person in charge of 2 22 the property at any time during the period beginning forty- 2 23 five days before the date of the election to which the signs 2 24 pertain and ending on the day of the election, even if such 2 25 placement would otherwise be a violation of this chapter. 2 26 However, if the property adjoins a city, county, or state 2 27 roadway, the time period during which signs may be placed on 2 28 the property shall commence thirty days prior to the date of 2 29 the election. This section shall not be construed to 2 30 authorize placement of any political sign at any location 2 31 where it may, because of its size, location, content or 2 32 coloring constitute a traffic hazard or a detriment to traffic 2 33 safety by obstructing the vision of drivers, by detracting 2 34 from the visibility of any traffic-control device or by being 2 35 confused with an authorized traffic-control device. The 3 1 exemption from provisions of this chapter granted by this 3 2 section for political signs shall expire on the seventh day 3 3 following the date of the election to which the signs pertain. 3 4 A municipal corporation shall adopt no ordinance which 3 5 prohibits the placement of political signs on private property 3 6 as permitted by this section during the period beginning 3 7 twenty-one days before the date of the election to which the 3 8 signs pertain, nor requires removal of the political signs so 3 9 placed less than seven days after the date of that election. 3 10 EXPLANATION 3 11 This bill shortens from 45 to 30 days the time period 3 12 preceding an election during which polictical yard signs may 3 13 be placed on property adjoining city, county, or state 3 14 roadways. 3 15 LSB 1909SS 76 3 16 lh/jj/8.1
