PAG LIN 1 1 Section 1. Section 2.43, unnumbered paragraph 2, Code 1 2 1995, is amended to read as follows: 1 3 In carrying out its duties under this section, the 1 4 legislative council shall consult with the director of the 1 5 department of general services and the capitol planning 1 6 commission, but shall not be bound by any decision of the 1 7 director in respect to the responsibilities and duties 1 8 provided for in this section. The legislative council may 1 9 direct the director of the department of general services or 1 10 other state employees to carry out its directives in regard to 1 11 the physical facilities of the general assembly, or may employ 1 12 other personnel to carry outsuchthose functions. However, 1 13 the legislative council shall not direct or approve changes in 1 14 the physical facilities that will radically change, obscure, 1 15 or destroy character-defining spaces, materials, features, or 1 16 finishes of a building as required for facilities listed in 1 17 the national register of historical places. 1 18 Sec. 2. Section 18.8, unnumbered paragraph 5, Code 1993, 1 19 is amended to read as follows: 1 20 Except for buildings and grounds described in section 1 21 216B.3, subsection 6, and section 2.43, unnumbered paragraph 1 22 1, the director shall assign office space at the capitol, 1 23 other state buildings and elsewhere in the city of Des Moines, 1 24 for all executive and judicial state agencies. Assignments 1 25 may be changed at any time. The various officers to whom 1 26 rooms have beensoassigned may control thesamerooms while 1 27 the assignment to them is in force. Changes in the physical 1 28 facilities shall not be made which radically change, obscure, 1 29 or destroy character-defining spaces, materials, features, or 1 30 finishes of a building as required for facilities listed in 1 31 the national register of historical places. Official 1 32 apartments shall be used only for the purpose of conducting 1 33 the business of the state. The term "capitol" or "capitol 1 34 building" as used in the Code shall be descriptive of all 1 35 buildings upon the capitol grounds. The capitol building 2 1 itself is reserved for the operations of the general assembly, 2 2 the governor, and the courts and the assignment and use of 2 3 physical facilities for the general assembly shall be pursuant 2 4 to section 2.43. 2 5 Sec. 3. NEW SECTION. 18.24 RESTORATION &endash; PRESERVATION. 2 6 Painting, remodeling, or construction in the state capitol 2 7 building or the old historical building may only be done after 2 8 consultation with the director of the department of general 2 9 services. Changes in these facilities that would radically 2 10 change, obscure, or destroy character-defining spaces, 2 11 materials, features, or finishes of a building as required for 2 12 facilities listed in the national register of historical 2 13 places shall not be made. 2 14 EXPLANATION 2 15 This bill requires the preservation of the exterior and 2 16 interior of the historical structures on the capitol complex. 2 17 Section 1 refers to the space occupied and under the control 2 18 of the legislature. Section 2 restricts space assigned to 2 19 other state governmental agencies from being altered. Section 2 20 3 deals with any painting, remodeling, construction, or other 2 21 restoration in the state capitol building or the old 2 22 historical building. 2 23 LSB 1381SS 76 2 24 mg/sc/14
