  1  1    Section 1.  Section 19A.3, Code 1995, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  23.  Employees of the Iowa state fair
  1  4 authority established pursuant to section 173.1.
  1  5    Sec. 2.  Section 173.1, unnumbered paragraph 1, Code 1995,
  1  6 is amended to read as follows:
  1  7    The Iowa state fair authority is established as a public
  1  8 instrumentality of the state.  The authority is not an agency
  1  9 of state government.  However, the authority is considered a
  1 10 state agency and its employees state employees for the
  1 11 purposes of chapter chapters 17A, the merit system provisions
  1 12 of chapter 19A, and chapters 20, 91B, 97B, 509A, and 669.  The
  1 13 authority is established to conduct an annual state fair and
  1 14 exposition on the Iowa state fairgrounds and to conduct other
  1 15 interim events consistent with its rules.  The powers of the
  1 16 authority are vested in the Iowa state fair board.  The Iowa
  1 17 state fair board consists of the following:  
  1 18                           EXPLANATION
  1 19    This bill amends a provision in chapter 19A which provides
  1 20 merit system provisions for state employees, and chapter 173
  1 21 which provides for the Iowa state fair authority.  The
  1 22 authority is not a state agency, but is required to comply
  1 23 with limited provisions applying to state agencies.  Section
  1 24 173.1 provides that the employees of the authority are
  1 25 considered state employees for purposes of the merit system
  1 26 provisions of chapter 19A.  This bill eliminates that
  1 27 provision from the section.
