1 1 Section 1. NEW SECTION. 6B.56 DISPOSITION OF PROPERTY ON
1 2 CONDEMNED PROPERTY.
1 3 1. If property located on real property condemned pursuant
1 4 to this chapter will not be retained or used by the condemnor,
1 5 the condemnor shall first offer the property for sale to the
1 6 general public prior to the removal or destruction of the
1 7 property by the condemnor.
1 8 2. The condemnor shall not be required to offer the
1 9 property for sale if the fair market value of the property to
1 10 be removed or destroyed does not exceed twenty-five dollars.
1 11 3. For purposes of this section, "property" includes, but
1 12 is not limited to, buildings, vegetation, dirt, structures,
1 13 and other improvements located on real property.
1 14 EXPLANATION
1 15 This bill provides that any property located on condemned
1 16 property shall be offered for sale to the public by the
1 17 condemnor if the condemnor does not intend to retain or use
1 18 the property but rather intends to either destroy or remove
1 19 the property. The condemnor need not offer the property for
1 20 sale if the fair market value of the property does not exceed
1 21 $25. The bill defines property to include buildings,
1 22 vegetation, dirt, and any other improvements located on the
1 23 real property.
