  1  1    Section 1.  Section 145B.3, Code 1995, is amended to read
  1  2 as follows:
  1  3    145B.3  DOGS HELD FOR REDEMPTION BY OWNER.
  1  4    An institution so authorized by the Iowa department of
  1  5 public health may request dogs from a pound.  The pound shall
  1  6 may tender to such institution all dogs in its custody seized
  1  7 or held by authority of the state, municipality, or other
  1  8 political subdivision, except that no.  However, a dog shall
  1  9 not be so tendered unless it has been held for redemption by
  1 10 its owner or for sale for a period of not less than three nor
  1 11 more than fifteen days and no.  A dog lawfully licensed at the
  1 12 time of its seizure shall not be so tendered unless its owner
  1 13 shall so consent consents in writing.  No dogs, except those
  1 14 actually Unless a dog is sick or injured or those lawfully
  1 15 licensed at the time of seizure, a pound shall be destroyed by
  1 16 a pound not destroy a dog while a request to that pound of an
  1 17 authorized institution to that pound is unfulfilled unless

  1 19                           EXPLANATION
  1 20    Section 145B.3 provides for the transfer of dogs by pounds
  1 21 to educational or scientific institutions authorized by the
  1 22 Iowa department of public health, and defined to mean
  1 23 facilities concerned with the investigation of biological
  1 24 functions and health of humans and animals.  The section
  1 25 provides that under certain conditions the pound must
  1 26 relinquish custody of dogs.  This bill grants the pound
  1 27 discretion to transfer a dog to an institution.  A pound is
  1 28 defined to mean any person having custody of dogs seized or
  1 29 held under the authority of the state or any municipality or
  1 30 any political subdivision of the state.
