PAG LIN 1 1 Section 1. NEW SECTION. 455B.152 MANURE SPRAYING DEVICES 1 2 AND EQUIPMENT &endash; PROHIBITION. 1 3 1. As used in this section: 1 4 a. "Agricultural land" means land suitable for the 1 5 cultivation of crops or pasture land suitable for growing hay, 1 6 grass, clover, or alfalfa. 1 7 b. "Manure spraying device" means any implement or 1 8 equipment used for applying manure in a liquid form above the 1 9 surface of the ground by the use of a pressurized system of 1 10 dispersal, including but not limited to a mechanical system 1 11 commonly used for irrigation. 1 12 2. A person shall not use or operate a manure spraying 1 13 device, manufactured on or after the effective date of this 1 14 Act, for purposes of applying liquid manure on agricultural 1 15 land. Beginning two years following the effective date of 1 16 this Act, a person shall not use or operate a manure spraying 1 17 device for purposes of applying liquid manure on the 1 18 agricultural land, regardless of the date that the device was 1 19 manufactured. 1 20 3. A person violating this section shall be subject to a 1 21 civil penalty according to the schedule of civil penalties 1 22 adopted by the commission pursuant to section 455B.109. 1 23 However, the civil penalty imposed shall not be more than one 1 24 thousand dollars. Each day that a violation continues shall 1 25 be considered a separate offense. 1 26 EXPLANATION 1 27 This bill prohibits a person from using or operating a 1 28 manure spraying device, manufactured on or after the effective 1 29 date of this bill, for purposes of applying liquid manure on 1 30 agricultural land. It also provides that two years following 1 31 the effective date of the bill, a person is prohibited from 1 32 using or operating a manure spraying device for purposes of 1 33 applying liquid manure on the agricultural land, regardless of 1 34 the date that the device was manufactured. The bill defines a 1 35 manure spraying device to mean any implement or equipment used 2 1 for applying manure in a liquid form above the surface of the 2 2 ground by the use of a pressurized system of dispersal. A 2 3 person violating this section is subject to a civil penalty 2 4 according to a schedule adopted by the environmental 2 5 protection commission. The civil penalty is limited to not 2 6 more than $1,000. Each day that a violation continues 2 7 constitutes a separate offense. 2 8 LSB 1039SS 76 2 9 da/cf/24
