1 1 Section 1. Section 135B.7, Code 1995, is amended by adding
1 2 the following new unnumbered paragraph:
1 3 NEW UNNUMBERED PARAGRAPH. The department shall adopt rules
1 4 requiring a hospital to disclose in the hospital's patient
1 5 billing statement the percentage of the amount charged to a
1 6 patient which is for marketing, advertising, and lobbying
1 7 costs incurred by the hospital.
1 8 Sec. 2. Section 507B.4, Code 1995, is amended by adding
1 9 the following new subsection:
1 10 NEW SUBSECTION. 13. FAILURE TO DISCLOSE CERTAIN COSTS.
1 11 Failure of a third-party payor, as defined in section 514C.6,
1 12 subsection 2, to disclose in the billing, coverage, or
1 13 services statements of the third-party payor the percentage of
1 14 the amount charged to a person receiving health care coverage
1 15 or services paid for by the third-party payor which is for
1 16 marketing, advertising, and lobbying costs incurred by a
1 17 hospital.
1 18 EXPLANATION
1 19 This bill requires the department of inspections and
1 20 appeals to adopt rules which require a hospital to disclose in
1 21 its patient billing statement the percentage of the amount
1 22 charged to its patients which is for marketing, advertising,
1 23 and lobbying costs incurred by the hospital.
1 24 The bill provides that it is an unfair trade practice for a
1 25 third-party payor, as defined in section 514C.6, subsection 2,
1 26 to disclose in the billing statements of the third-party payor
1 27 the percentage of the amount charged to a person provided
1 28 health care coverage or services by the third-party payor
1 29 which is for marketing, advertising, and lobbying costs
1 30 incurred by the hospital.
