1 1 Section 1. NEW SECTION. 327F.15 REFLECTIVE DEVICES ON
1 2 RAILROAD CARS &endash; PENALTY.
1 3 1. Any person, firm, or corporation owning or operating a
1 4 railroad car in this state shall ensure that the railroad car,
1 5 while operated upon stationary rails in this state and while
1 6 coupled with a railroad train, shall be equipped with a
1 7 reflective device plainly visible to approaching vehicular
1 8 traffic pursuant to rules established by the state department
1 9 of transportation.
1 10 2. A violation of this section shall, upon conviction, be
1 11 subject to a schedule "one" penalty.
1 12 EXPLANATION
1 13 This bill requires that all railroad cars while operating
1 14 on the railroad tracks of this state shall be equipped with a
1 15 reflective device plainly visible to approaching vehicles
1 16 pursuant to rules established by the state department of
1 17 transportation. A violation of this section is considered a
1 18 schedule "one" violation pursuant to section 327C.5,
1 19 subjecting the violator to a $100 fine for each violation.
