  1  1          SENATE CONCURRENT RESOLUTION NO. ___
  1  2                  BY  BANKS and HANSEN
  1  3 A Concurrent Resolution relating to border city truck-
  1  4    ing agreements.
  1  5    WHEREAS, in the early 1970s the states of Iowa,
  1  6 Nebraska, and South Dakota developed border city
  1  7 agreements which allowed for the free flow of trade
  1  8 among the states; and
  1  9    WHEREAS, these compacts allowed farmers, truckers,
  1 10 and other business people to cross state boundaries;
  1 11 and
  1 12    WHEREAS, federal regulations have required states
  1 13 to prohibit divisible loads with a gross weight in
  1 14 excess of 80,000 pounds on interstate highways; and
  1 15    WHEREAS, states were allowed grandfather rights if
  1 16 the state had authorized heavier loads or had issued
  1 17 overweight permits for divisible loads in effect on
  1 18 July 1, 1956; and
  1 19    WHEREAS, Iowa did not allow heavier loads or issue
  1 20 overweight permits as of July 1, 1956, and therefore
  1 21 is not eligible for grandfather rights; and
  1 22    WHEREAS, the federal Highway Administration will
  1 23 not allow Iowa to change its laws without imposition
  1 24 of sanctions; and
  1 25    WHEREAS, the states of Nebraska and South Dakota
  1 26 have grandfather provisions which allow the use of
  1 27 divisible loads in excess of 80,000 pounds; and
  1 28    WHEREAS, one example of the problem is the movement
  1 29 of livestock into the Sioux City stockyards from
  1 30 Nebraska and South Dakota in trailers which exceed
  2  1 Iowa's legal gross weight of 80,000 pounds, although
  2  2 the vehicles are otherwise within legal requirements
  2  3 per axle; and
  2  4    WHEREAS, because such vehicles are not legal in
  2  5 Iowa, farmers are forced to lighten their loads or
  2  6 truck their livestock to terminals farther away; and
  2  7    WHEREAS, this increases costs, reduces profits, and
  2  8 adversely affects border city stockyards; and
  2  9    WHEREAS, the Secretary of the United States
  2 10 Department of Transportation, Federico Pena, has
  2 11 stated that he does not have the authority to grant
  2 12 Iowa a waiver from the federal regulations; NOW
  2 13 THEREFORE,
  2 14    BE IT RESOLVED BY THE SENATE, THE HOUSE OF
  2 15 REPRESENTATIVES CONCURRING, That the Iowa General
  2 16 Assembly requests that a federal waiver be authorized
  2 17 to allow the state of Iowa to update the border city
  2 18 agreement so that trucks may enter Iowa's western
  2 19 boundaries to load and unload without violating Iowa's
  2 20 weight restrictions; and
  2 21    BE IT FURTHER RESOLVED, That copies of this
  2 22 resolution be sent to the President of the United
  2 23 States Senate, the Speaker of the United States House
  2 24 of Representatives, and to members of Iowa's
  2 25 congressional delegation.
