  1  1    Amend the amendment, S-5863, to Senate File 2470 as
  1  2 follows:
  1  3    #1.  Page 1, by inserting after line 3 the
  1  4 following:
  1  5    "Sec.    .  Section 702.11, Code 1995, is amended
  1  6 to read as follows:
  1  7    702.11  FORCIBLE FELONY.
  1  8    A "forcible felony" is any felonious child
  1  9 endangerment, assault, murder, sexual abuse,
  1 10 kidnapping, robbery, arson in the first degree, or
  1 11 burglary in the first degree.  However, sexual abuse
  1 12 in the third degree committed between spouses, sexual
  1 13 abuse in violation of section 709.4, subsection 2,
  1 14 paragraph "c", subparagraph (4), or sexual
  1 15 exploitation by a counselor or therapist in violation
  1 16 of section 709.15, or sexual exploitation by a law
  1 17 enforcement officer in violation of section 709.15A is
  1 18 not a "forcible felony"."
  1 19    #2.  Page 2, by striking line 4 and inserting the
  1 20 following:  "is a health care provider.
  1 21    Sec.    .  NEW SECTION.  709.15A  SEXUAL
  1 22 EXPLOITATION BY A LAW ENFORCEMENT OFFICER – PENALTY.
  1 23    1.  As used in this section:
  1 24    a.  "Law enforcement officer" means a peace officer
  1 25 employed by the state or a political subdivision of
  1 26 the state.
  1 27    b.  "Sexual exploitation by a law enforcement
  1 28 officer" occurs when a sex act, as defined in section
  1 29 702.17, occurs between a law enforcement officer and a
  1 30 victim at any time between the time the victim is
  1 31 responded to or the victim's case is opened and the
  1 32 time a conviction or plea of guilty is obtained or the
  1 33 case is closed.
  1 34    c.  "Victim" means a person who is the subject of
  1 35 an act being investigated or responded to by a law
  1 36 enforcement officer as a crime.
  1 37    2.  A law enforcement officer who commits sexual
  1 38 exploitation commits a class "D" felony."
