1 2 #1. Page 33, by inserting after line 23 the
1 3 following:
1 4 "Sec. . Section 708.3A, Code Supplement 1995,
1 5 as amended by 1996 Iowa Acts, Senate File 2167,
1 6 section 1, is amended to read as follows:
1 7 708.3A ASSAULTS ON PEACE OFFICERS, FIRE FIGHTERS,
1 8 AND HEALTH CARE PROVIDERS.
1 9 1. A person who commits an assault, as defined in
1 10 section 708.1, against a peace officer, whether on-
1 11 duty or not, health care provider, or fire fighter,
1 12 whether paid or volunteer, with the knowledge that the
1 13 person against whom the assault is committed is a
1 14 peace officer, health care provider, or fire fighter
1 15 and with the intent to inflict a serious injury upon
1 16 the peace officer, health care provider, or fire
1 17 fighter, is guilty of a class "D" felony.
1 18 2. A person who commits an assault, as defined in
1 19 section 708.1, against a peace officer, whether on-
1 20 duty or not, health care provider, or fire fighter,
1 21 whether paid or volunteer, who knows that the person
1 22 against whom the assault is committed is a peace
1 23 officer, health care provider, or fire fighter and who
1 24 uses or displays a dangerous weapon in connection with
1 25 the assault, is guilty of a class "D" felony.
1 26 3. A person who commits an assault, as defined in
1 27 section 708.1, against a peace officer, whether on-
1 28 duty or not, health care provider, or fire fighter,
1 29 whether paid or volunteer, who knows that the person
1 30 against whom the assault is committed is a peace
1 31 officer, health care provider, or fire fighter, and
1 32 who causes bodily injury or disabling mental illness,
1 33 is guilty of an aggravated misdemeanor.
1 34 4. Any other assault, as defined in section 708.1,
1 35 committed against a peace officer, whether on-duty or
1 36 not, health care provider, or fire fighter, whether
1 37 paid or volunteer, by a person who knows that the
1 38 person against whom the assault is committed is a
1 39 peace officer, health care provider, or fire fighter,
1 40 is a serious misdemeanor.
1 41 5. As used in this section, "health care provider"
1 42 means an emergency medical care provider as defined in
1 43 chapter 147A or a person licensed or registered under
1 44 chapter 148, 148C, 148D, 150, 150A, or 152 who is
1 45 providing or who is attempting to provide emergency
1 46 medical services, as defined in section 147A.1, or who
1 47 is providing or who is attempting to provide health
1 48 services as defined in section 135.61 in a hospital.
1 49 A person who commits an assault under this section
1 50 against a health care provider in a hospital, or at
2 1 the scene or during out-of-hospital patient
2 2 transportation in an ambulance, is presumed to know
2 3 that the person against whom the assault is committed
2 4 is a health care provider."

2 7 "Sec. . REPEAL. 1996 Iowa Acts, Senate File
2 8 2080, section 62, is repealed."
