  1  1    Amend the House amendment, S-5818, to Senate File
  1  2 2370, as amended, passed, and reprinted by the Senate,
  1  3 as follows:
  1  4    #1.  Page 1, by inserting after line 31 the
  1  5 following:
  1  6    "#   .  Page 11, by inserting before line 24 the
  1  7 following:
  1  8    "Sec.    .  NEW SECTION.  476.46  LEGISLATIVE
  1  9 INTENT – SERVICE TERRITORY EXCEPTIONS.
  1 10    It is the intent of the general assembly that a
  1 11 hydroelectric energy supplier who has proceeded in
  1 12 good faith under the terms and conditions of chapter
  1 13 476 not suffer economic loss as a result of action or
  1 14 inaction taken by the state.  Notwithstanding the
  1 15 service territory restrictions contained in chapter
  1 16 476, a hydroelectric energy supplier who has entered
  1 17 into an agreement prior to January 1, 1996, to energy
  1 18 supply a local governmental entity with electricity,
  1 19 shall be allowed to do so.""
  1 20    #2.  By renumbering as necessary.
