  1  1    Amend the House amendment, S-5818, to Senate File
  1  2 2370, as amended, passed, and reprinted by the Senate,
  1  3 as follows:
  1  4    #1.  Page 1, by inserting after line 31 the
  1  5 following:
  1  6    "#   .  Page 11, by inserting before line 24 the
  1  7 following:
  1  8    "Sec.    .  NEW SECTION.  476.46  LEGISLATIVE
  1  9 INTENT – SERVICE TERRITORY EXCEPTIONS.
  1 10    It is the intent of the general assembly that an
  1 11 energy supplier who has proceeded in good faith under
  1 12 the terms and conditions of chapter 476 not suffer
  1 13 economic loss as a result of action or inaction taken
  1 14 by the state.  Notwithstanding the service territory
  1 15 restrictions contained in chapter 476, an energy
  1 16 supplier who has entered into a contract prior to
  1 17 January 1, 1996, to supply a local governmental entity
  1 18 with electricity, shall be allowed to do so.""
  1 19    #2.  By renumbering as necessary.
