PAG LIN 1 1 Amend House File 428 as follows: 1 2 #1. By striking everything after the enacting 1 3 clause and inserting the following: 1 4 "Section 1. Section 34A.2, subsection 6, paragraph 1 5 e, subparagraph (2), Code 1995, is amended to read as 1 6 follows: 1 7 (2) Recurring costs, including, but not limited 1 8 to, network access fees and other telephone charges, 1 9 software, equipment,anddatabase management, and 1 10 maintenance, including the purchase or lease of 1 11 subscriber names, addresses, and telephone information 1 12 from the local exchange service provider. Recurring 1 13 costs shall not include personnel costs for a public 1 14 safety answering point. 1 15 Sec. 2. Section 34A.2, subsection 6, paragraph e, 1 16 unnumbered paragraph 2, Code 1995, is amended to read 1 17 as follows: 1 18 Funds deposited in an E911 service fund, with the 1 19 prior approval of the county board of supervisors, 1 20 shall be appropriated and used for the payment of 1 21 costs which are limited to nonrecurring and recurring 1 22 costs directly attributable to the provision of 911 1 23 emergency telephone communication service and may 1 24 include costs for portable and vehicle radios, 1 25 communication towers and associated equipment, and 1 26 other radios and equipment permanently located at the 1 27 public safety answering point. Costs do not include 1 28 expenditures for any other purpose, and specifically 1 29 exclude costs attributable to other emergency services 1 30 or expenditures for buildings or personnel, except for 1 31 the costs of personnel for database management and 1 32 personnel directly associated with addressing. 1 33 Sec. 3. Section 34A.3, subsection 1, unnumbered 1 34 paragraph 1, Code 1995, is amended to read as follows: 1 35 The board of supervisors of each county shall 1 36 establish a joint 911 service board not later than 1 37 January 1, 1989. Each political subdivisionof the1 38state having a public safety agency serving territory1 39 within the county is entitled to voting membership on 1 40 the joint 911 service board. Eachprivatepublic 1 41 safety agency operating within the area is entitled to 1 42nonvotingvoting membership on the board.A township1 43which does not operate its own public safety agency,1 44but contractsEach private safety agency under 1 45 contract with a political subdivision within the 1 46 county for the provision of public safety services, is1 47not entitled to membership on the joint 911 service1 48board, but its contractor is entitled to membership1 49according to the contractor's status as a public or1 50private safety agencyis entitled to voting membership 2 1 on the board. The board of supervisors of the county 2 2 establishing the board is also entitled to voting 2 3 membership on the board. The joint 911 service board 2 4 shall develop an enhanced 911 service plan 2 5 encompassing at minimum the entire county, unless an 2 6 exemption is granted by the administrator permitting a 2 7 smaller E911 service area. The administrator may 2 8 grant a discretionary exemption from the single county 2 9 minimum service area requirement based upon an E911 2 10 joint service board's or other E911 service plan 2 11 operating authority's presentation of evidence which 2 12 supports the requested exemption if the administrator 2 13 finds that local conditions make adherence to the 2 14 minimum standard unreasonable or technically 2 15 infeasible, and that the purposes of this chapter 2 16 would be furthered by granting an exemption. The 2 17 minimum size requirement is intended to prevent 2 18 unnecessary duplication of public safety answering 2 19 points and minimize other administrative, personnel, 2 20 and equipment expenses. An E911 service area must 2 21 encompass a geographically contiguous area. No 2 22 exemption shall be granted from the contiguous area 2 23 requirement. The administrator may order the 2 24 inclusion of a specific territory in an adjoining E911 2 25 service plan area to avoid the creation by exclusion 2 26 of a territory smaller than a single county not 2 27 serviced by surrounding E911 service plan areas upon 2 28 request of the joint 911 service board representing 2 29 the territory. The E911 service plan operating 2 30 authority shall submit the plan on or before January 2 31 1, 1994, to all of the following:" 2 32 #2.
