1 1 Amend Senate File 2370 as follows:
1 2 #1. Page 2, by striking lines 21 and 22 and
1 3 inserting the following:
1 4 "Sec. 50. Section 476.2, subsections 5, 6, and 7,
1 5 Code 1995, are amended by striking the subsections and
1 6 inserting in lieu thereof the following:
1 7 5. Each rate-regulated gas and electric utility
1 8 operating within the state shall maintain with the
1 9 state the utility's principal office for Iowa
1 10 operations. The principal office shall be subject to
1 11 the jurisdiction of the board and shall house all of
1 12 the utility's books, accounts, papers, and records
1 13 required to be maintained by the board. The utility
1 14 shall maintain within the state administrative,
1 15 technical, and operating personnel necessary for the
1 16 delivery of safe and reasonably adequate services and
1 17 facilities as required pursuant to section 476.8. A
1 18 public utility which violates this section shall be
1 19 subject to the penalties provided in section 476.51
1 20 and shall be denied authority to recover, for a period
1 21 determined by the board, the costs of an energy
1 22 efficiency plan pursuant to section 476.6, subsection
1 23 11.
1 24 6. The board shall provide the general assembly
1 25 with a report on the energy efficiency planning
1 26 efforts undertaken by utilities required to offer
1 27 energy efficiency plans pursuant to section 476.6,
1 28 subsection 17. The report shall be completed by
1 29 January 1, 1998."
1 30 #2. Page 7, by inserting after line 2 the
1 31 following:
1 32 "Sec. . Section 50 of this Act, being deemed of
1 33 immediate importance, takes effect upon enactment."
1 34 #3. Title page, line 4, by inserting after the
1 35 word "research" the following: "and requiring the
1 36 location of a principal office within the state and
1 37 providing an effective date".
