  1  1    Amend House File 2256, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  By striking everything after the enacting
  1  4 clause and inserting the following:
  1  5    "Sec.    .  Section 8.41, Code 1995, is amended by
  1  6 adding the following new subsection:
  1  7    NEW SUBSECTION.  3.  a.  If, in any federal fiscal
  1  8 year, the federal government provides for a block
  1  9 grant which requires a new or revised program than was
  1 10 required in the prior fiscal year, each state agency
  1 11 required to administer the block grant program shall
  1 12 develop a block grant plan detailing program changes.
  1 13    b.  To the extent allowed by federal law, the block
  1 14 grant plan shall be developed in accordance with the
  1 15 following:
  1 16    (1)  The primary goal of the plan shall be to
  1 17 attain savings for taxpayers and to avoid shifting
  1 18 costs from the federal government to state and local
  1 19 governments.
  1 20    (2)  State agency planning meetings shall be held
  1 21 jointly with officials of the affected political
  1 22 subdivision and affected members of the public.
  1 23    (3)  The plan shall address proposed expenditures
  1 24 and accountability measures and shall be published so
  1 25 as to provide reasonable opportunity for public review
  1 26 and comment.
  1 27    (4)  (a)  Preference shall be given to any existing
  1 28 service delivery system capable of delivering the
  1 29 required service.  If an existing service delivery
  1 30 system is not used, the plan shall identify those
  1 31 existing delivery systems which were considered and
  1 32 the reasons those systems were rejected.  This
  1 33 subparagraph subdivision applies to any service
  1 34 delivered pursuant to a federal block grant,
  1 35 including, but not limited to any of the following
  1 36 block grant areas:  health, human services, education,
  1 37 employment, community and economic development, and
  1 38 criminal justice.
  1 39    (b)  If a service delivered pursuant to a federal
  1 40 block grant and implemented by a political subdivision
  1 41 was previously provided for by a categorical grant,
  1 42 the state agency shall allow the political subdivision
  1 43 adequate transition time to accommodate related
  1 44 changes in federal and state policy.  Transition
  1 45 activities may include, but are not limited to,
  1 46 revision of the political subdivision's laws, budgets,
  1 47 and administrative procedures.
  1 48    (c)  The state agency shall allow the political
  1 49 subdivision the flexibility to implement a service in
  1 50 a manner so as to address identifiable needs within
  2  1 the context of meeting broad national objectives.
  2  2    (5)  State administrative costs shall not exceed
  2  3 the limits allowed for under the federal law enacting
  2  4 the block grant.
  2  5    (6)  A federal mandate that is eliminated or waived
  2  6 for the state shall be eliminated or waived for a
  2  7 political subdivision.
  2  8    (7)  Federal block grants shall not be used to
  2  9 supplant existing funding efforts by the state.
  2 10    c.  The state agency shall send copies of the
  2 11 proposed block grant plan to the legislative fiscal
  2 12 committee and to the appropriate appropriations
  2 13 subcommittee chairpersons and ranking members of the
  2 14 general assembly.  The plan and any program changes
  2 15 contained within the plan shall be adopted as rules in
  2 16 accordance with chapter 17A.
  2 17    Sec. 2.  EFFECTIVE DATE – APPLICABILITY.  This
  2 18 Act, being deemed of immediate importance, takes
  2 19 effect upon enactment and applies to new or revised
  2 20 federal block grant provisions which take effect on or
  2 21 after the effective date of this Act."
