NATIONAL ASSESSMENT OF EDUCATION PROGRESS 4 15 (NAEP) 4 16 For participation by the department of education in 4 17 a state and national project to determine the academic 4 18 achievement of Iowa students in math, reading, 4 19 science, United States history, or geography: 4 20 .................................................. $ 50,000 4 21 16. Notwithstanding 1994 Iowa Acts, chapter 5 40 1193, section 2, subsection 2, funds appropriated and 5 41 allocated to the merged areas pursuant to 1994 Iowa 5 42 Acts, chapter 1193, section 2, for the fiscal year 5 43 beginning July 1, 1994, and ending June 30, 1995, 5 44 pursuant to section 8.53, unnumbered paragraph 1, 5 45 shall be paid to the merged areas by June 30, 1995. 5 46 Sec. 3. The department of education shall, in 5 47 consultation with the Iowa association of community 5 48 college presidents and the Iowa association of 5 49 community college trustees, conduct a study of funding 5 50 for community colleges, and shall make specific 6 1 recommendations on the elimination of chapter 260D and 6 2 for alternatives to present community college funding 6 3 including, but not limited to, a plan for distribution 6 4 of funds to community colleges. The department shall 6 5 submit a report of its findings and recommendations to 6 6 the governor and the general assembly by December 1, 6 7 1995. 6 8 COLLEGE STUDENT AID COMMISSION 6 9 Sec. 4. There is appropriated from the general 6 10 fund of the state to the college student aid 6 11 commission for the fiscal year beginning July 1, 1995, 6 12 and ending June 30, 1996, the following amounts, or so 6 13 much thereof as may be necessary, to be used for the 6 14 purposes designated: 6 15 1. GENERAL ADMINISTRATION 6 16 For salaries, support, maintenance, miscellaneous 6 17 purposes, and for not more than the following full- 6 18 time equivalent positions: 6 19 .................................................. $ 321,256 6 20 ............................................... FTEs 7.05 6 21 From the moneys appropriated in this subsection, 6 22 $15,000 for the fiscal year beginning July 1, 1995, 6 23 and ending June 30, 1996, shall be expended to provide 6 24 grants to students who would meet the requirements for 6 25 receipt of a vocational-technical tuition grant, but 6 26 who are enrolled in a licensed school of cosmetology 6 27 arts and sciences under chapter 157, or a licensed 6 28 barber school under chapter 158. The amount of the 6 29 grant made by the college student aid commission 6 30 pursuant to this subsection shall be not less than 6 31 $300 or the amount of the student's established 6 32 financial need. 6 33 2. UNIVERSITY OF OSTEOPATHIC MEDICINE AND HEALTH 6 34 SCIENCES 6 35 a. For forgivable loans to Iowa students attending 6 36 the university of osteopathic medicine and health 6 37 sciences, under the forgivable loan program pursuant 6 38 to section 261.19A: 6 39 .................................................. $ 379,260 6 40 b. For the university of osteopathic medicine and 6 41 health sciences for an initiative in primary health 6 42 care to direct primary care physicians to shortage 6 43 areas in the state: 6 44 .................................................. $ 395,000 6 45 The moneys appropriated in this lettered paragraph 6 46 shall be used as follows: 6 47 (1) To reduce student loan debt for primary care 6 48 physicians in an amount not to exceed $30,000 per 6 49 student for a four-year period of medical service in 6 50 medically under-served areas of the state. 7 1 (2) For tuition scholarships for students 7 2 attending the university of osteopathic medicine and 7 3 health sciences who agree to practice primary care 7 4 medicine in medically under-served areas of the state. 7 5 The student shall practice in the state two years for 7 6 every year of tuition. A person receiving funds under 7 7 this subparagraph shall not be eligible for funds 7 8 under subparagraph (1). 7 9 (3) For general administration costs of the 7 10 university for the primary care initiative, the 7 11 university shall expend an amount not to exceed 7 12 $50,000. 7 13 The university of osteopathic medicine and health 7 14 sciences shall report quarterly to the legislative 7 15 fiscal bureau concerning the expenditure of funds used 7 16 pursuant to subparagraphs (1), (2), and (3) of this 7 17 lettered paragraph. The university shall also submit 7 18 the annual audit of the university to the legislative 7 19 fiscal bureau within six months following the year 7 20 being audited. The college student aid commission 7 21 shall not provide moneys for subparagraphs (1) and (2) 7 22 of this lettered paragraph until the university has 7 23 signed and submitted contracts for the use of these 7 24 moneys for reduction of student loan debt and tuition 7 25 scholarships. Funds for subparagraph (3) of this 7 26 lettered paragraph shall be provided quarterly to the 7 27 university. Notwithstanding section 8.33, the funds 7 28 for this lettered paragraph shall not revert to the 7 29 general fund but be available for expenditure the 7 30 following fiscal year for purposes of subparagraphs 7 31 (1) and (2). 7 32 3. STUDENT AID PROGRAMS 7 33 For payments to students for the Iowa grant 7 34 program: 7 35 .................................................. $ 1,469,790 7 36 From the moneys appropriated in this subsection, 7 37 $1,397,790 for the fiscal year beginning July 1, 1995, 7 38 and ending June 30, 1996, shall be expended for an 7 39 Iowa grant program, with funds to be allocated to 7 40 institutions pursuant to section 261.93A. FTEs 5,780.87 9 30 The university of Iowa hospitals and clinics shall 9 31 submit quarterly a report regarding the portion of the 9 32 appropriation in this lettered paragraph expended on 9 33 general support in a format jointly developed by the 9 34 university of Iowa hospitals and clinics, the 9 35 legislative fiscal bureau, and the department of 9 36 management which delineates the expenditures and 9 37 purposes of the funds. 9 38 Funds appropriated in this lettered paragraph shall 9 39 not be used to perform abortions except medically 9 40 necessary abortions, and shall not be used to operate 9 41 the early termination of pregnancy clinic except for 9 42 the performance of medically necessary abortions. For 9 43 the purpose of this lettered paragraph, an abortion is 9 44 the purposeful interruption of pregnancy with the 9 45 intention other than to produce a live-born infant or 9 46 to remove a dead fetus, and a medically necessary 9 47 abortion is one performed under one of the following 9 48 conditions: 9 49 (1) The attending physician certifies that 9 50 continuing the pregnancy would endanger the life of 10 1 the pregnant woman. 10 2 (2) The attending physician certifies that the 10 3 fetus is physically deformed, mentally deficient, or 10 4 afflicted with a congenital illness. 10 5 (3) The pregnancy is the result of a rape which is 10 6 reported within 45 days of the incident to a law 10 7 enforcement agency or public or private health agency 10 8 which may include a family physician. 10 9 (4) The pregnancy is the result of incest which is 10 10 reported within 150 days of the incident to a law 10 11 enforcement agency or public or private health agency 10 12 which may include a family physician. 10 13 (5) The abortion is a spontaneous abortion, 10 14 commonly known as a miscarriage, wherein not all of 10 15 the products of conception are expelled. 10 16 The total quota allocated to the counties for 10 17 indigent patients for the fiscal year beginning July 10 18 1, 1995, shall not be lower than the total quota 10 19 allocated to the counties for the fiscal year 10 20 commencing July 1, 1994. The total quota shall be 10 21 allocated among the counties on the basis of the 1990 10 22 census pursuant to section 255.16. 10 23 d. MEDICAL ASSISTANCE &endash; SUPPLEMENTAL 15 6 AMOUNTS. For the fiscal year beginning July 1, 1995, 15 7 and ending June 30, 1996, the department of human 15 8 services shall continue the supplemental 15 9 disproportionate share and a supplemental indirect 15 10 medical education adjustment applicable to state-owned 15 11 acute care hospitals with more than 500 beds and shall 15 12 reimburse qualifying hospitals pursuant to that 15 13 adjustment with a supplemental amount for services 15 14 provided medical assistance recipients. The 15 15 adjustment shall generate supplemental payments 15 16 intended to equal the state appropriation made to a 15 17 qualifying hospital for treatment of indigent patients 15 18 as provided in chapter 255. To the extent of the 15 19 supplemental payments, a qualifying hospital shall, 15 20 after receipt of the funds, transfer to the department 15 21 of human services an amount equal to the actual 15 22 supplemental payments that were made in that month. 15 23 The aggregate amounts for the fiscal year shall not 15 24 exceed the state appropriation made to the qualifying 15 25 hospital for treatment of indigent patients as 15 26 provided in chapter 255. The department of human 15 27 services shall deposit the portion of these funds 15 28 equal to the state share in the department's medical 15 29 assistance account and the balance shall be credited 15 30 to the general fund of the state. To the extent that 15 31 state funds appropriated to a qualifying hospital for 15 32 the treatment of indigent patients as provided in 15 33 chapter 255 have been transferred to the department of 15 34 human services as a result of these supplemental 15 35 payments made to the qualifying hospital, the 15 36 department shall not, directly or indirectly, recoup 15 37 the supplemental payments made to a qualifying 15 38 hospital for any reason, unless an equivalent amount 15 39 of the funds transferred to the department of human 15 40 services by a qualifying hospital pursuant to this 15 41 provision is transferred to the qualifying hospital by 15 42 the department. 15 43 If the state supplemental amount allotted to the 15 44 state of Iowa for the federal fiscal year beginning 15 45 October 1, 1995, and ending September 30, 1996, 15 46 pursuant to section 1923 (f)(3) of the federal Social 15 47 Security Act, as amended, or pursuant to federal 15 48 payments for indirect medical education is greater 15 49 than the amount necessary to fund the federal share of 15 50 the supplemental payments specified in the preceding 16 1 paragraph, the department of human services shall 16 2 increase the supplemental disproportionate share or 16 3 supplemental indirect medical education adjustment by 16 4 the lesser of the amount necessary to utilize fully 16 5 the state supplemental amount or the amount of state 16 6 funds appropriated to the state university of Iowa 16 7 general education fund and allocated to the university 16 8 for the college of medicine. The state university of 16 9 Iowa shall transfer from the allocation for the 16 10 college of medicine to the department of human 16 11 services, on a monthly basis, an amount equal to the 16 12 additional supplemental payments made during the 16 13 previous month pursuant to this paragraph. A 16 14 qualifying hospital receiving supplemental payments 16 15 pursuant to this paragraph that are greater than the 16 16 state appropriation made to the qualifying hospital 16 17 for treatment of indigent patients as provided in 16 18 chapter 255 shall be obligated as a condition of its 16 19 participation in the medical assistance program to 16 20 transfer to the state university of Iowa general 16 21 education fund on a monthly basis an amount equal to 16 22 the funds transferred by the state university of Iowa 16 23 to the department of human services. To the extent 16 24 that state funds appropriated to the state university 16 25 of Iowa and allocated to the college of medicine have 16 26 been transferred to the department of human services 16 27 as a result of these supplemental payments made to the 16 28 qualifying hospital, the department shall not, 16 29 directly or indirectly, recoup these supplemental 16 30 payments made to a qualifying hospital for any reason, 16 31 unless an equivalent amount of the funds transferred 16 32 to the department of human services by the state 16 33 university of Iowa pursuant to this paragraph is 16 34 transferred to the qualifying hospital by the 16 35 department. 16 36 Continuation of the supplemental disproportionate 16 37 share and supplemental indirect medical education 16 38 adjustment shall preserve the funds available to the 16 39 university hospital for medical and surgical treatment 16 40 of indigent patients as provided in chapter 255 and to 16 41 the state university of Iowa for educational purposes 16 42 at the same level as provided by the state funds 16 43 initially appropriated for that purpose. 16 44 The department of human services shall, in any 16 45 compilation of data or other report distributed to the 16 46 public concerning payments to providers under the 16 47 medical assistance program, set forth reimbursements 16 48 to a qualifying hospital through the supplemental 16 49 disproportionate share and supplemental indirect 16 50 medical education adjustment as a separate item and 17 1 shall not include such payments in the amounts 17 2 otherwise reported as the reimbursement to a 17 3 qualifying hospital for services to medical assistance 17 4 recipients. 17 5 For purposes of this section, "supplemental 17 6 payment" means a supplemental payment amount paid for 17 7 medical assistance to a hospital qualifying for that 17 8 payment under this section. 17 9 DEPARTMENT OF CULTURAL AFFAIRS 17 10 Sec. 10. Notwithstanding section 8.33, funds 18 15 appropriated in 1994 Iowa Acts, chapter 1193, section 18 16 14, remaining unencumbered or unobligated on June 30, 18 17 1995, shall not revert to the general fund of the 18 18 state but shall be available for purposes of the Iowa 18 19 grant program, in addition to funds appropriated in 18 20 section 4, subsection 3, of this Act, with funds to be 18 21 distributed pursuant to section 261.93A. 18 22 Sec. 13. Notwithstanding section 257B.1A, 18 23 subsection 4, and 1994 Iowa Acts, chapter 1193, 18 24 section 15, for the fiscal year beginning July 1, 18 25 1994, and ending June 30, 1995, the remaining portion 18 26 of the interest earned on the permanent school fund 18 27 shall, after transfers are made pursuant to section 18 28 257B.1A, subsections 2 and 3, be deposited in the 18 29 interest for Iowa schools fund established under this 18 30 Act. 18 31 Sec. 14. There is appropriated from the 18 32 scholarship and tuition grant reserve fund to the 18 33 college student aid commission for the fiscal year 18 34 beginning July 1, 1995, and ending June 30, 1996, the 18 35 amount of $160,000 for purposes of the work-study 18 36 program, in addition to funds appropriated in section 18 37 261.85. 18 38 Sec. 15. Funds appropriated for state scholarships 18 39 pursuant to section 261.25, subsection 2, for the 18 40 fiscal year beginning July 1, 1995, and ending June 18 41 30, 1996, shall be used in their entirety to fund 18 42 scholarships to eligible students, and the college 18 43 student aid commission shall not place an across-the- 18 44 board ceiling on the amount distributed under the 18 45 state scholarship program. 18 46 Sec. 16. Section 257B.1, subsection 5, Code 1995, 18 47 is amended by striking the subsection. 18 48 Sec. 17. Section 257B.1A, Code 1995, is amended by 18 49 striking the section and inserting in lieu thereof the 18 50 following: 19 1 257B.1A TRANSFER OF INTEREST. 19 2 1. The interest for Iowa schools fund is 19 3 established in the office of treasurer of state. The 19 4 department of revenue and finance shall deposit 19 5 interest earned on the permanent school fund in the 19 6 interest for Iowa schools fund. Moneys in the 19 7 interest for Iowa schools fund shall be transferred or 19 8 allocated only for school purposes as provided in this 19 9 section. 19 10 2. For a transfer of moneys from the interest for 19 11 Iowa schools fund to the first in the nation in 19 12 education foundation, prior to July 1, October 1, 19 13 January 1, and March 1 of each year, the governing 19 14 board of the first in the nation in education 19 15 foundation established in section 257A.2 shall certify 19 16 to the treasurer of state the cumulative total value 19 17 of contributions received under section 257A.7 for 19 18 deposit in the first in the nation in education fund 19 19 and for the use of the foundation. The cumulative 19 20 total value of contributions received includes the 19 21 value of the amount deposited in the national center 19 22 endowment fund established in section 263.8A in excess 19 23 of eight hundred seventy-five thousand dollars. The 19 24 value of in-kind contributions shall be based upon the 19 25 fair market value of the contribution determined for 19 26 income tax purposes. 19 27 The portion of the interest in Iowa schools fund 19 28 that is equal to the cumulative total value of 19 29 contributions, less the portion of the interest in 19 30 Iowa schools fund dedicated to the national center for 19 31 gifted and talented education, is dedicated to the 19 32 first in the nation in education foundation for that 19 33 year. The interest earned on this dedicated amount 19 34 shall be transferred by the treasurer of state to the 19 35 credit of the first in the nation in education 19 36 foundation. 19 37 3. For a transfer of moneys from the interest in 19 38 Iowa schools fund to the national center endowment 19 39 fund established in section 263.8A, prior to July 1, 19 40 October 1, January 1, and March 1 of each year, the 19 41 state university of Iowa shall certify to the 19 42 treasurer of state the cumulative total value of 19 43 contributions received and deposited in the national 19 44 center endowment fund. Within fifteen days following 19 45 certification by the state university of Iowa, the 19 46 treasurer of state shall transfer from the interest in 19 47 Iowa schools fund to the national center an amount 19 48 equal to one-half the cumulative total value of the 19 49 contributions deposited in the national center 19 50 endowment fund, not to exceed eight hundred seventy- 20 1 five thousand dollars. 20 2 Sec. 18. NEW SECTION. 260C.24 PAYMENT OF 20 3 APPROPRIATION. 20 4 Payment of appropriations for distribution under 20 5 this chapter or of appropriations made in lieu of such 20 6 appropriations, shall be made by the department of 20 7 revenue and finance in monthly installments due on or 20 8 about the fifteenth of each month of a budget year, 20 9 and installments shall be as nearly equal as possible, 20 10 as determined by the department of revenue and 20 11 finance, taking into consideration the relative budget 20 12 and cash position of the state resources. 20 13 Sec. 19. NEW SECTION. 260C.29 CAREER OPPORTUNITY 20 14 PROGRAM &endash; MISSION. 20 15 1. The mission of the career opportunity program 20 16 established in this section is to encourage 20 17 collaborative efforts by a community college, the 20 18 institutions under the control of the state board of 20 19 regents, and business and industry to enhance the 20 20 educational opportunities and provide for job creation 20 21 and career advancement for Iowa's minority persons by 20 22 providing assistance to minority persons who major in 20 23 fields or subject areas where minorities are currently 20 24 underrepresented or underutilized. 20 25 2. A career opportunity program is established to 20 26 be administered by the community college located in a 20 27 county with a population in excess of three hundred 20 28 thousand. The community college shall provide office 20 29 space for the efficient operation of the program. The 20 30 community college shall employ a director for the 20 31 program. The director of the program shall employ 20 32 necessary support staff. The director and staff shall 20 33 be employees of the community college. 20 34 3. The director of the program shall do the 20 35 following: 20 36 a. Direct the coordination of the program between 20 37 the community college and the institutions of higher 20 38 education under the control of the state board of 20 39 regents. 20 40 b. Propose rules to the state board of education 20 41 as necessary to implement the program. 20 42 c. Recruit minority persons into the program. 20 43 d. Enlist the assistance and cooperation of 20 44 leaders from business and industry to provide job 20 45 placement services for students who are successfully 20 46 completing the program. 20 47 e. Prepare and submit an annual report to the 20 48 governor and the general assembly by January 15. 20 49 4. To be eligible for the program, a minority 20 50 person shall be a resident of Iowa who is accepted for 21 1 admission at or attends a community college or an 21 2 institution of higher education under the control of 21 3 the state board of regents. In addition, the person 21 4 shall major in or achieve credit toward an associate 21 5 degree, a bachelor's degree, or a master's degree in a 21 6 field or subject area where minorities are 21 7 underrepresented or underutilized. 21 8 5. The amount of assistance provided to a student 21 9 under this section shall not exceed the cost of 21 10 tuition, fees, and books required for the program in 21 11 which the student is enrolled and attends. As used in 21 12 this section, "books" may include book substitutes, 21 13 including reusable workbooks, loose-leaf or bound 21 14 manuals, and computer software materials used as book 21 15 substitutes. A student who meets the qualifications 21 16 of this section shall receive assistance under this 21 17 section for not more than the equivalent of two full 21 18 years of study. 21 19 6. For purposes of this section, "minority person" 21 20 means a person who is Black, Hispanic, Asian, or a 21 21 Pacific Islander, American Indian, or an Alaskan 21 22 native American. 21 23 Sec. 20. Section 260D.14A, unnumbered paragraphs 1 21 24 and 5, Code 1995, are amended to read as follows: 21 25 The department of education shall provide for the 21 26 establishment of a community college excellence 2000 21 27 account in the office of the treasurer of state for 21 28 deposit of moneys appropriated to the account for 21 29 purposes of funding quality instructional centers and 21 30 program and administrative sharing agreements under 21 31 sections 260C.45 and 260C.46. There is appropriated 21 32 from the general fund of the state to the department 21 33 of education for the fiscal year beginning July 1, 21 3419951997, an amount equal to two and five-tenths 21 35 percent of the total state general aid generated for 21 36 all community colleges during the budget year under 21 37 this chapter for deposit in the community college 21 38 excellence 2000 account. In the next succeeding two 21 39 fiscal years, the percent multiplier shall be 21 40 increased in equal increments until the multiplier 21 41 reaches seven and one-half percent of the total state 21 42 general aid generated for all community colleges 21 43 during the budget year. 21 44 It is the intent of the general assembly that the 21 45 general assembly enact legislation by July 1,199521 46 1997, that will increase the maximum percent 21 47 multiplier established in this section from seven and 21 48 five-tenths percent to ten percent. 21 49 Sec. 21. Section 261.12, subsection 1, paragraph 21 50 b, Code 1995, is amended to read as follows: 22 1 b. For the fiscal year beginning July 1,198922 2 1995, and for each following fiscal year, two thousand 22 3sixnine hundredfiftydollars. 22 4 Sec. 22. Section 261.25, subsection 1, Code 1995, 22 5 is amended to read as follows: 22 6 1. There is appropriated from the general fund of 22 7 the state to the commission for each fiscal year the 22 8 sum ofthirty-twothirty-five millionfoursix hundred 22 9twenty-twosixty-four thousandthreeseven hundred 22 10sixty-twofifty dollars for tuition grants. 22 11 Sec. 23. NEW SECTION. 261.51 CHIROPRACTIC 22 12 GRADUATE STUDENT FORGIVABLE LOANS. 22 13 1. A chiropractic graduate student forgivable loan 22 14 program is established, to be administered by the 22 15 college student aid commission for resident graduate 22 16 students who are enrolled at Iowa chiropractic 22 17 colleges and universities. A resident graduate 22 18 student attending an Iowa chiropractic college or 22 19 university is eligible for loan forgiveness under the 22 20 program if the student meets all of the following 22 21 conditions: 22 22 a. The student graduates from an Iowa chiropractic 22 23 college or university that meets the requirements for 22 24 approval under section 151.4. 22 25 b. The student has completed a chiropractic 22 26 residency program. 22 27 c. The student practices in the state of Iowa. 22 28 d. The student has made application for, using the 22 29 procedures specified in section 261.16, and received 22 30 moneys through the college student aid commission from 22 31 the funds allocated for loans under this section. 22 32 2. Of the moneys loaned to an eligible student, 22 33 for each year of up to and including four years of 22 34 practice in Iowa, the amount of one thousand one 22 35 hundred dollars shall be forgiven. If a student fails 22 36 to complete a year of practice in the state, the loan 22 37 amount for that year shall not be forgiven. 22 38 Forgivable loans made to eligible students shall not 22 39 become due, for repayment purposes, until after the 22 40 student has completed the student's residency. 22 41 3. For purposes of this section "graduate student" 22 42 means a student who has completed at least ninety 22 43 semester hours, or the trimester or quarter 22 44 equivalent, of postsecondary course work at a public 22 45 higher education institution or at an accredited 22 46 private institution, as defined under section 261.9. 22 47 The college student aid commission shall adopt rules, 22 48 consistent with rules used for students enrolled in 22 49 higher education institutions under the control of the 22 50 state board of regents, for purposes of determining 23 1 Iowa residency status of graduate students under this 23 2 section. The commission shall also adopt rules which 23 3 provide standards, guidelines, and procedures for the 23 4 receipt, processing, and administration of student 23 5 applications and loans under this section. 23 6 Sec. 24. Section 261.85, unnumbered paragraph 1, 23 7 Code 1995, is amended to read as follows: 23 8 There is appropriated from the general fund of the 23 9 state to the commission for each fiscal year the sum 23 10 of two millioneightnine hundredninety-eightfifty 23 11 thousandeight hundred fortydollars for the work- 23 12 study program. 23 13 Sec. 25. Section 262.2, Code 1995, is amended to 23 14 read as follows: 23 15 262.2 APPOINTMENT &endash; TERM OF OFFICE. 23 16 1. The members shall be appointed by the governor 23 17 subject to confirmation by the senate. The term of 23 18 each member of the board shall be for six years. The 23 19 terms of three members of the board shall begin and 23 20 expire in each odd-numbered year as provided in 23 21 section 69.19. 23 22 2. The recognized student government organization 23 23 at each of the three institutions of higher learning 23 24 under the control of the board shall submit, at least 23 25 biennially, to the executive director who shall 23 26 transfer to the governor a list of at least three 23 27 names of students eligible to represent the 23 28 institution on the board. The governor may appoint 23 29 the ninth member of the board from the lists of names 23 30 submitted by the recognized student organizations. 23 31 Sec. 26. Section 275.55A, Code 1995, is amended to 23 32 read as follows: 23 33 275.55A ATTENDANCE IN OTHER DISTRICT. 23 34 Apupilstudent enrolled in ninth, tenth, or 23 35 eleventh grade during the school year preceding the 23 36 effective date of a dissolution proposal, who was a 23 37 resident of the school district that dissolved, may 23 38 enroll inanya school district to which territory of 23 39 the school district that dissolved was attached until 23 40that pupil'sthe student's graduation from high 23 41 school, unless the student was expelled or suspended 23 42 from school and the conditions of expulsion or 23 43 suspension have not been met. The student under 23 44 expulsion or suspension shall not be enrolled until 23 45 the board of directors of the school district to which 23 46 territory of the dissolved school district was 23 47 attached approves, by majority vote, the enrollment of 23 48 the student. Notwithstanding section 282.24, the 23 49 district of residence of thepupilstudent, determined 23 50 in the dissolution proposal, shall pay tuition to the 24 1 school district selected by thepupilstudent in an 24 2 amount not to exceed the district cost per pupil of 24 3 the district of residence and the school district 24 4 selected by thepupilstudent shall accept that 24 5 tuition payment and enroll thepupilstudent. 24 6 Sec. 27. Section 282.4, Code 1995, is amended to 24 7 read as follows: 24 8 282.4 SUSPENSION &endash; EXPULSION&endash; DISMISSAL. 24 9 1. The board may, by a majority vote, expel any 24 10pupilstudent from school for a violation of the 24 11 regulations or rules established by the board, or when 24 12 the presence of thepupilstudent is detrimental to 24 13 the best interests of the school. The board may 24 14 confer upon any teacher, principal, or superintendent 24 15 the power temporarily todismisssuspend apupil24 16 student, notice ofsuch dismissalthe suspension being 24 17 at once given in writing to the president of the 24 18 board. 24 19 2. Apupilstudent who commits an assault, as 24 20 defined under section 708.1, against a school employee 24 21 in a school building, on school grounds, or at a 24 22 school-sponsored function shall be suspended for a 24 23 time to be determined by the principal. Notice of the 24 24 suspension shall be immediately sent to the president 24 25 of the board. By special meeting or at the next 24 26 regularly scheduled board meeting, the board shall 24 27 review the suspension and decide whether to hold a 24 28 disciplinary hearing to determine whether or not to 24 29 order further sanctions against thepupilstudent, 24 30 which may include expelling thepupilstudent. In 24 31 making its decision, the board shall consider the best 24 32 interests of the school district, which shall include 24 33 what is best to protect and ensure the safety of the 24 34 school employees andpupilsstudents from thepupil24 35 student committing the assault. 24 36 Apupilstudent shall not be suspended or expelled 24 37 pursuant to this section if the suspension or 24 38 expulsion would violate the federal Individuals with 24 39 Disabilities Education Act. 24 40 3. Notwithstanding section 282.6, if a student has 24 41 been expelled or suspended from school and has not met 24 42 the conditions of the expulsion or suspension and if 24 43 the student, or the parent or guardian of the student, 24 44 changes district of residence, the student shall not 24 45 be enrolled in the new district of residence until the 24 46 board of directors of the new district of residence 24 47 approves, by a majority vote, the enrollment of the 24 48 student. 24 49 Sec. 28. Section 282.5, Code 1995, is amended to 24 50 read as follows: 25 1 282.5 READMISSION OF STUDENT. 25 2 When a student isdismissedsuspended by a teacher, 25 3 principal, or superintendent, pursuant to section 25 4 282.4, the student may be readmitted by the teacher, 25 5 principal, or superintendent, but when expelled by the 25 6 board the student may be readmitted only by the board 25 7 or in the manner prescribed by the board. 25 8 Sec. 29. Section 294A.25, subsection 8, Code 1995, 25 9 is amended to read as follows: 25 10 8. For the fiscal year beginning July 1,199425 11 1995, to the department of education from phase III 25 12 moneys the amount of one million two hundred fifty 25 13 thousand dollars for support for the operations of the 25 14 new Iowa schools development corporation and for 25 15 school transformation design and implementation 25 16 projects administered by the corporation. Of the 25 17 amount provided in this subsection, one hundred fifty 25 18 thousand dollars shall be used for the school and 25 19 community planning initiative. 25 20 Sec. 30. Section 303.3, subsection 3, Code 1995, 25 21 is amended to read as follows: 25 22 3. Notwithstanding section 8.33, moneys committed 25 23 to grantees under contract that remain unexpended on 25 24 June 30 of any fiscal year shall not revert but shall 25 25 be available for expenditure for purposes of the 25 26contractprogram until June 30 of the succeeding 25 27 fiscal year. 25 28 Sec. 31. FUNDS TRANSFERRED. 25 29 1. For the fiscal year beginning July 1, 1995, and 25 30 ending June 30, 1996, the amount of $150,000 is to be 25 31 paid to the department of education from additional 25 32 funds transferred from phase I to phase III for 25 33 development of a K-12 and community college management 25 34 information system. Notwithstanding section 294A.20, 25 35 if the additional funds transferred from phase I to 25 36 phase III are insufficient for purposes of the 25 37 appropriation provided under this subsection, moneys 25 38 allocated to phase III, which would otherwise revert 25 39 to the general fund under section 294A.20, shall be 25 40 transferred to the department in an amount sufficient 25 41 to fully fund the appropriation made under this 25 42 subsection. The department shall submit a report to 25 43 the legislative fiscal bureau by January 1, 1996, 25 44 describing the specific expenditure of funds 25 45 appropriated by the general assembly for purposes of 25 46 the management information system; the estimated time 25 47 of completion of the system; the department's 25 48 accomplishments under the system; and any 25 49 recommendations for future system funding needs. 25 50 2. For the fiscal year beginning July 1, 1995, and 26 1 ending June 30, 1996, up to $50,000 from additional 26 2 funds transferred from phase I to phase III is to be 26 3 paid to the department of education for support of the 26 4 Iowa mathematics and science coalition. If funds 26 5 available from the specified sources are insufficient 26 6 to fully fund the appropriation, the amount 26 7 appropriated to the department under this subsection 26 8 shall be reduced to an amount equal to the available 26 9 funds. 26 10 Sec. 32. 1994 Iowa Acts, chapter 1193, section 15, 26 11 is repealed. 26 12 Sec. 33. Sections 2, 11 through 13, 16, 17, 26 26 13 through 28, 30, and this section of this Act, being 26 14 deemed of immediate importance, take effect upon 26 15 enactment."" 26 16 26 17 26 18 26 19 JOHN P.
