  1  1    Amend the amendment, S-3365, to House File 303, as
  1  2 passed by the House, as follows:
  1  3    #1.  Page 1, by striking lines 2 through 29.
  1  4    #2.  By striking page 1, line 32 through page 2,
  1  5 line 7 and inserting the following:
  1  6    ""Sec.    .  NEW SECTION.  480.9  LIABILITY FOR
  1  7 OWNER OF FARMLAND.
  1  8    An owner of farmland used in a farm operation, as
  1  9 defined in section 352.2, who complies with the
  1 10 requirements of this chapter shall not be held
  1 11 responsible for any damages to an underground
  1 12 facility, including fiber optic cable, if the damage
  1 13 occurred on the farmland in the normal course of the
  1 14 farm operation, unless the owner intentionally damaged
  1 15 the underground facility or acted with wanton
  1 16 disregard or recklessness in causing the damage to the
  1 17 underground facility.  For purposes of this section,
  1 18 an "owner" includes a family member, employee, or
  1 19 tenant of the owner.""
