1 2 #1. Page 7, line 14, by striking the word "may"
1 3 and inserting the following: "shall".
1 4 #2. Page 7, line 14, by striking the words "and
1 5 any" and inserting the following: "and used to commit
1 6 the offense and any other".
1 7 #3. Page 7, line 15, by striking the words
1 8 "operated by the person" and inserting the following:
1 9 "used by the person in the commission of the offense".
1 10 #4. Page 7, line 16, by inserting after the word
1 11 "immobilized." the following: "For purposes of this
1 12 section, "immobilized" means the installation of a
1 13 device that completely prevents a motor vehicle from
1 14 being operated, or the installation of an ignition
1 15 interlock device, of a type approved by the
1 16 commissioner of public safety, in a motor vehicle."
1 17 #5. Page 12, by inserting after line 2 the follow-
1 18 ing:
1 19 " . Notwithstanding the requirements of this
1 20 section, any of the following persons may make
1 21 application to the court for permission to operate a
1 22 motor vehicle, which is impounded or immobilized
1 23 pursuant to this section, during the period of im-
1 24 poundment or immobilization, if the applicant's motor
1 25 vehicle license or operating privilege has not been
1 26 suspended, denied, or revoked, and an ignition
1 27 interlock device of a type approved by the
1 28 commissioner of public safety is installed in the
1 29 motor vehicle prior to operation:
1 30 a. A person, other than the person who committed
1 31 the offense which resulted in the impoundment or
1 32 immobilization, who is not a member of the immediate
1 33 family of the person who committed the offense but is
1 34 a joint owner of the motor vehicle.
1 35 b. A member of the immediate family of the person
1 36 who committed the offense which resulted in the
1 37 impoundment or immobilization, if the member
1 38 demonstrates that the motor vehicle that is subject to
1 39 the order for impoundment or immobilization is the
1 40 only motor vehicle possessed by the family.
1 41 For purposes of this section, "a member of the
1 42 immediate family" means a spouse, child, or parent of
1 43 the person who committed the offense."
1 44 #6. By numbering and renumbering as necessary.
