1 1 Amend Senate File 446 as follows:
1 2 #1. Page 1, by inserting after line 12, the
1 3 following:
1 4 "Sec. . Section 321.89, subsection 1, paragraph
1 5 b, Code 1995, is amended by adding the following new
1 6 subparagraph:
1 7 NEW SUBPARAGRAPH. (6) A vehicle that has been
1 8 impounded pursuant to section 321J.4B by order of the
1 9 court and whose owner has not paid the impoundment
1 10 fees after notification by the person or agency
1 11 responsible for carrying out the impoundment order."
1 12 #2. Page 8, by inserting after line 32 the
1 13 following:
1 14 " . Upon receipt of the court order for
1 15 impoundment or immobilization and seizure of the motor
1 16 vehicle, if the agency responsible for carrying out
1 17 the order determines that the motor vehicle is to be
1 18 impounded, the agency shall review the value of the
1 19 vehicle in relation to the costs associated with the
1 20 period of impoundment of the motor vehicle specified
1 21 in the order. If the agency determines that the costs
1 22 of impoundment of the motor vehicle exceed the actual
1 23 wholesale value of the motor vehicle, the agency may
1 24 treat the vehicle as an abandoned vehicle pursuant to
1 25 section 321.89. If the agency elects to treat the
1 26 motor vehicle as abandoned, the agency shall notify
1 27 the registered owner of the motor vehicle that the
1 28 vehicle shall be deemed abandoned and shall be sold in
1 29 the manner provided in section 321.89 if payment of
1 30 the total cost of impoundment is not received within
1 31 twenty-one days of the mailing of the notice. The
1 32 agency shall provide documentation regarding the
1 33 valuation of the vehicle and the costs of impoundment.
1 34 This paragraph shall not apply to vehicles that are
1 35 immobilized pursuant to this section or if subsection
1 36 14 or 15 applies."
