PAG LIN 1 1 Section 1. NEW SECTION. 80.41 HIGHWAY SAFETY PATROL 1 2 FUND. 1 3 A highway safety patrol fund is created as a separate fund 1 4 in the state treasury. Interest and other moneys earned by 1 5 the fund shall be deposited in the fund. The fund shall 1 6 include moneys credited from the use tax as allocated under 1 7 section 423.24, subsection 2. The moneys credited to the fund 1 8 for the fiscal year beginning July 1, 1995, and ending June 1 9 30, 1996, shall be appropriated as follows: 1 10 1. Thirty-two million, nine hundred sixty thousand, four 1 11 hundred sixty-seven dollars shall be appropriated to the 1 12 division of highway safety, uniformed force, and radio 1 13 communications of the department of public safety to be used 1 14 for salaries, support, maintenance, and miscellaneous 1 15 purposes, including the state's contribution to the peace 1 16 officers' retirement, accident, and disability system provided 1 17 in chapter 97A in the amount of eighteen percent of the 1 18 salaries for which the funds are appropriated. 1 19 2. Any revenues remaining shall be credited to the primary 1 20 road fund created under section 313.3 to be used for the 1 21 development and improvement of the commercial and industrial 1 22 highway network under section 313.2A. 1 23 It is the intent of the general assembly that moneys be 1 24 appropriated from the general fund of the state to partially 1 25 fund the division of highway safety, uniformed force, and 1 26 radio communications of the department of public safety by 1 27 fiscal year 1997 and to fully fund the division by fiscal year 1 28 2001 and each fiscal year thereafter. It is further intended 1 29 that the fund created in this section be repealed when the 1 30 highway patrol is fully funded from the general fund of the 1 31 state and all use tax receipts designated in section 423.24, 1 32 subsection 2, are deposited in the road use tax fund. 1 33 Sec. 2. Section 423.24, subsection 2, Code 1995, is 1 34 amended to read as follows: 1 35 2. Twenty percent of all revenue derived from the use tax 2 1 on motor vehicles, trailers, and motor vehicle accessories and 2 2 equipment as collected pursuant to section 423.7 shall be 2 3 deposited in theGAAP deficit reduction account established in2 4the department of management pursuant to section 8.57,2 5subsection 2,highway safety patrol fund created in section 2 6 80.41, and shall be used in accordance with the provisions of 2 7 that section. 2 8 EXPLANATION 2 9 This bill allocates 20 percent of use tax revenues to a 2 10 highway safety patrol fund rather than the GAAP deficit 2 11 reduction account. It creates a highway safety patrol fund 2 12 and allocates $32,960,467 of the moneys deposited in the fund 2 13 to the division of highway safety, uniformed force, and radio 2 14 communications of the department of public safety for the 2 15 fiscal year beginning July 1, 1995, and ending June 30, 1996. 2 16 The remaining moneys are appropriated to the primary road fund 2 17 to be used for the development and improvement of the state's 2 18 commercial and industrial highway network. The bill provides 2 19 language indicating that the intent of the general assembly is 2 20 to partially fund the highway patrol from the general fund of 2 21 the state in fiscal year 1997 and to fully fund the highway 2 22 patrol from the general fund of the state by fiscal year 2001 2 23 and each fiscal year thereafter. It states that it is further 2 24 intended by the general assembly that the highway safety 2 25 patrol fund be repealed and the use tax receipts be deposited 2 26 in the road use tax fund. 2 27 LSB 1950HC 76 2 28 js/jj/8.1
