1 1 Section 1. Section 235A.16, Code 1995, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 4. A written request for child abuse
1 4 information involving a provider of child day care, as defined
1 5 in section 237A.1, is subject to a fee of two dollars for each
1 6 central child abuse registry check. If a registry check is
1 7 made regarding an employee of an authorized requester, the fee
1 8 shall be paid by the authorized requester and shall not be
1 9 charged to the employee.
1 10 Sec. 2. Section 237A.3, subsection 1, paragraph a, Code
1 11 1995, is amended to read as follows:
1 12 a. A person who operates or establishes a family day care
1 13 home which provides care for four children or less may apply
1 14 to the department for registration under this chapter. A
1 15 person who operates or establishes a family day care home
1 16 which provides care for five or more children shall apply to
1 17 the department for registration under this chapter. A person
1 18 who fails to register as required under this section commits a
1 19 crime which is subject to a penalty under section 237A.19.
1 20 The department shall issue a certificate of registration upon
1 21 receipt of a statement from the family day care home that the
1 22 home complies with rules adopted by the department. The
1 23 registration certificate shall be posted in a conspicuous
1 24 place in the family day care home, shall state the name of the
1 25 registrant, the number of individuals who may be received for
1 26 care at any one time, and the address of the home, and shall
1 27 include a check list of registration compliances.
1 28 EXPLANATION
1 29 This bill relates to child day care by providing for a fee
1 30 for abuse registry checks of child day care providers and
1 31 requiring registration of certain family day care homes.
1 32 Section 235A.16, relating to requests for child abuse
1 33 information, is amended to apply a fee of $2 for a child abuse
1 34 registry check involving a child day care provider. If a
1 35 check is performed on an employee of an authorized requester,
2 1 the bill requires the fee to be paid by the authorized
2 2 requester and is not to be charged to the employee.
2 3 Section 237A.3, relating to registration of family and
2 4 group day care homes, is amended to require registration of a
2 5 family day care home which provides care to five or more
2 6 children. Under current law, registration of family day care
2 7 homes is voluntary. A failure to register as required by the
2 8 bill is a simple misdemeanor under section 237A.19.
