PAG LIN 1 1 Section 1. NEW SECTION. 514C.11 POSTDELIVERY BENEFITS 1 2 AND CARE. 1 3 1. Notwithstanding section 514C.6, a person who provides 1 4 an individual or group policy of accident or health insurance 1 5 or individual or group hospital or health care service 1 6 contract issued pursuant to chapter 509, 509A, 514, or 514A or 1 7 an individual or group health maintenance organization 1 8 contract issued and regulated under chapter 514B, which is 1 9 delivered, amended, or renewed on or after July 1, 1996, and 1 10 which provides maternity benefits, which are not limited to 1 11 complications of pregnancy, or newborn care benefits, shall 1 12 not terminate inpatient benefits or require discharge of a 1 13 mother or the newborn from a hospital following delivery 1 14 earlier than determined to be medically appropriate by the 1 15 attending physician after consultation with the mother and in 1 16 accordance with guidelines adopted by rule by the 1 17 commissioner. The guidelines adopted by rule shall be 1 18 consistent with or may adopt by reference the guidelines for 1 19 perinatal care established by the American academy of 1 20 pediatrics and the American college of obstetricians and 1 21 gynecologists which provide that when complications are not 1 22 present, the postpartum hospital stay ranges from a minimum of 1 23 forty-eight hours for a vaginal delivery to a minimum of 1 24 ninety-six hours for a cesarean birth, excluding the day of 1 25 delivery. The guidelines adopted by rule by the commissioner 1 26 shall also provide that in the event of a discharge from the 1 27 hospital prior to the minimum stay established in the 1 28 guidelines, a postdischarge follow-up visit shall be provided 1 29 to the mother and newborn by providers competent in postpartum 1 30 care and newborn assessment if determined medically 1 31 appropriate as directed by the attending physician, in 1 32 accordance with the guidelines. 1 33 2. When performing utilization review of inpatient 1 34 hospital services related to maternity and newborn care, 1 35 including but not limited to length of postdelivery stay and 2 1 postdischarge follow-up care, any person who provides an 2 2 individual or group policy of accident or health insurance or 2 3 individual or group hospital or health care service contract 2 4 issued pursuant to chapter 509, 509A, 514, or 514A, or an 2 5 individual or group health maintenance organization contract 2 6 issued and regulated under chapter 514B, shall use the 2 7 guidelines adopted by rule by the commissioner, and shall not 2 8 deselect, require additional documentation, require additional 2 9 utilization review, terminate services to, reduce payment to, 2 10 or in any manner provide a disincentive to an attending 2 11 physician solely on the basis that the attending physician 2 12 provided or directed the provision of services in compliance 2 13 with the guidelines adopted by rule. 2 14 3. Preauthorization or precertification for a hospital 2 15 stay or for a postdischarge follow-up visit in accordance with 2 16 the guidelines adopted by rule by the commissioner shall not 2 17 be required. 2 18 HF 2369 2 19 pf/pk/25
