PAG LIN 1 1 Section 1. Section 455B.172, Code 1995, is amended by 1 2 adding the following new subsection: 1 3 NEW SUBSECTION. 9. Pursuant to one or more chapter 28E 1 4 agreements entered into by the department and the county 1 5 boards of health for Appanoose, Clarke, Decatur, Lucas, 1 6 Monroe, and Wayne counties, the department may delegate its 1 7 authority to the county boards of health in those counties, 1 8 under the authority granted to the county boards of health in 1 9 chapter 137, to inspect water in or originating from the 1 10 Rathbun water impoundment. The inspection may include 1 11 testing, monitoring, and analyzing water in or originating 1 12 from the water impoundment. The county board of health shall 1 13 only inspect water in or originating from the water 1 14 impoundment if all of the following apply: 1 15 a. The inspection is within an area where the point of 1 16 pollution could occur between manure from an animal feeding 1 17 operation structure which is part of a confinement feeding 1 18 operation and water in or originating from the water 1 19 impoundment. 1 20 b. The confinement feeding operation confines and feeds 1 21 swine. 1 22 c. The total manure storage capacity of manure storage 1 23 structures connected to the confinement feeding operation is 1 24 four million gallons or more. 1 25 A county may impose a special annual fee on each such 1 26 confinement feeding operation, in order to reimburse the 1 27 county board of health for administering this subsection. If 1 28 unpaid when due as provided by the county, the amount shall be 1 29 placed upon the tax books and collected, with interest and 1 30 penalties after due, in the same manner as other unpaid 1 31 property taxes. 1 32 EXPLANATION 1 33 This bill provides that the department of natural resources 1 34 may pursuant to a chapter 28E agreement delegate authority to 1 35 a county board of health to inspect water originating from a 2 1 water impoundment which serves a large public water supply 2 2 system for Appanoose, Clarke, Decatur, Lucas, Monroe, and 2 3 Wayne counties. The inspection is limited to areas which may 2 4 be threatened by manure from confinement feeding operations in 2 5 which swine are confined and which have a manure storage 2 6 capacity of four million gallons or more. The inspection may 2 7 include testing, monitoring, and analyzing the water. The 2 8 bill provides that an animal feeding operation may be required 2 9 to annually pay a fee to the county board of health for 2 10 purposes of reimbursing the board for expenses related to 2 11 carrying out inspections. 2 12 LSB 4004YH 76 2 13 da/jw/5.3
