PAG LIN 1 1 Section 1. Section 99E.9, subsection 3, paragraph j, Code 1 2 Supplement 1995, is amended to read as follows: 1 3 j. The method to be used in printing and selling tickets 1 4 or shares. An elected official's name shall not be printed on 1 5 the tickets. The toll-free telephone number used by the 1 6 department of human services for its gamblers assistance 1 7 program shall be printed on the tickets or shares. The 1 8 overall estimated odds of winning a prize in a given game 1 9 shall be printed on each ticket if the games have either 1 10 preprinted winners or fixed odds. Estimated odds of winning a 1 11 prize are not required to be printed on tickets in lottery 1 12 games of a pari-mutuel nature. As used in this paragraph, 1 13 "games of a pari-mutuel nature" means a game in which the 1 14 amount of the winnings and the odds of winning are determined 1 15 by the number of participants in the game. 1 16 Sec. 2. Section 99E.10, subsection 1, paragraph a, Code 1 17 1995, is amended to read as follows: 1 18 a. An amount equal to three-tenths of one percent of the 1 19 gross lottery revenue shall be deposited in a gamblers 1 20 assistance fund in the office of the treasurer of state. The 1 21 director of human services shall administer the fund and shall 1 22 provide that receipts are allocated on a monthly basis to 1 23 provide programs which may include, but are not limited to, 1 24 outpatient and follow-up treatment for persons affected by 1 25 problem gambling, treatment for spouses and children of 1 26 problem gamblers, employer education for identification and 1 27 referral of problem gamblers, rehabilitation and residential 1 28 treatment programs, information and referral services, and 1 29 education and preventive services. The educational, 1 30 advertising, and informational material and services shall 1 31 include focuses on prevention of problem gambling and on 1 32 assisting spouses and children of problem gamblers. 1 33 Sec. 3. Section 99E.10, subsection 1, unnumbered paragraph 1 34 2, Code 1995, is amended to read as follows: 1 35 Lottery expenses for marketing, educational, and 2 1 informational material shall not exceedfour percentthe 2 2 amount of the gross lottery revenue contributed to the 2 3 gamblers assistance fund as provided in paragraph "a". 2 4 Sec. 4. Section 99E.16, subsection 2, Code 1995, is 2 5 amended to read as follows: 2 6 2. A licensee shall sell tickets or shares only on the 2 7 premises stated in the license. Except for the lottery 2 8 division, the licensee shall only sell a ticket or share in 2 9 person and not over a telephone or through the mail. However, 2 10 the lottery division may sell lottery tickets or shares over 2 11 the telephone or through the mail. The licensee may accept 2 12 payment by cash, check, money order, debit card, or electronic 2 13 funds transfer. A licensee shall not accept one or more 2 14 checks totaling more than five hundred dollars from one person 2 15 during a twenty-four-hour period to purchase tickets or 2 16 shares. The licensee shall not extend or arrange credit for 2 17 the purchase of a ticket or share. As used in this subsection 2 18 "cash" means United States currency. 2 19 Sec. 5. Section 99F.9, subsection 6, Code 1995, is amended 2 20 to read as follows: 2 21 6. A licensee shall not accept a credit card as defined in 2 22 section 537.1301, subsection 16, to purchase coins, tokens, or 2 23 other forms of credit to be wagered on gambling games. A 2 24 licensee shall not accept one or more checks totaling more 2 25 than five hundred dollars from one person during a twenty- 2 26 four-hour period to be wagered on gambling games. 2 27 EXPLANATION 2 28 This bill includes proposals to reduce the amount of 2 29 advertising to promote gambling, and increase programs and 2 30 advertising to assist problem gamblers and their families. 2 31 The bill provides that the toll-free telephone number used by 2 32 the department of human services to assist problem gamblers be 2 33 printed on all lottery tickets and shares. The bill limits 2 34 the total amount of checks accepted by a licensee for lottery 2 35 and gambling games to $500 per 24-hour period. 3 1 The bill also limits the amount of money spent by the state 3 2 lottery for information, education, and marketing to the same 3 3 amount that is allocated to the gamblers assistance fund. 3 4 The bill also provides that the department of human 3 5 services focus advertising and public information on 3 6 prevention of problem gambling and assisting spouses and 3 7 children of problem gamblers to cope with the gambling 3 8 problem.
