PAG LIN 1 1 Section 1. Section 8.41, Code 1995, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 3. a. If, in any federal fiscal year, 1 4 the federal government provides for a block grant which 1 5 requires a new or revised program than was required in the 1 6 prior fiscal year, each state agency required to administer 1 7 the block grant program shall develop a block grant plan 1 8 detailing program changes. 1 9 b. To the extent allowed by federal law, the block grant 1 10 plan shall be developed in accordance with the following: 1 11 (1) The primary goal of the plan shall be to attain 1 12 savings for taxpayers and to avoid shifting costs from the 1 13 federal government to state and local governments. 1 14 (2) State agency planning meetings shall be held jointly 1 15 with officials of the affected political subdivision and 1 16 affected members of the public. 1 17 (3) The plan shall address proposed expenditures and 1 18 accountability measures and shall be published so as to 1 19 provide reasonable opportunity for public review and comment. 1 20 (4) (a) Preference shall be given to any existing service 1 21 delivery system capable of delivering the required service. 1 22 If an existing service delivery system is not used, the plan 1 23 shall identify those existing delivery systems which were 1 24 considered and the reasons those systems were rejected. This 1 25 subparagraph subdivision applies to any service delivered 1 26 pursuant to a federal block grant, including, but not limited 1 27 to any of the following block grant areas: health, human 1 28 services, education, employment, community and economic 1 29 development, and criminal justice. 1 30 (b) If a service delivered pursuant to a federal block 1 31 grant and implemented by a political subdivision was 1 32 previously provided for by a categorical grant, the state 1 33 agency shall allow the political subdivision adequate 1 34 transition time to accommodate related changes in federal and 1 35 state policy. Transition activities may include, but are not 2 1 limited to, revision of the political subdivision's laws, 2 2 budgets, and administrative procedures. 2 3 (c) The state agency shall allow the political subdivision 2 4 the flexibility to implement a service in a manner so as to 2 5 address identifiable needs within the context of meeting broad 2 6 national objectives. 2 7 (5) State administrative costs shall not exceed the limits 2 8 allowed for under the federal law enacting the block grant. 2 9 (6) A federal mandate that is eliminated or waived for the 2 10 state shall be eliminated or waived for a political 2 11 subdivision. 2 12 (7) Federal block grants shall not be used to supplant 2 13 existing funding efforts by the state. 2 14 c. The state agency shall send copies of the proposed 2 15 block grant plan to the legislative fiscal committee and to 2 16 the appropriate appropriations subcommittee chairpersons and 2 17 ranking members of the general assembly. The plan and any 2 18 program changes contained within the plan shall be adopted as 2 19 rules in accordance with chapter 17A. 2 20 Sec. 2. EFFECTIVE DATE – APPLICABILITY. This Act, being 2 21 deemed of immediate importance, takes effect upon enactment 2 22 and applies to new or revised federal block grant provisions 2 23 which take effect on or after the effective date of this Act. 2 24 HF 2256 2 25 jp/pk/25
