1 1 Section 1. Section 34A.6A, Code 1995, is amended to read
1 2 as follows:
1 3 34A.6A ALTERNATIVE SURCHARGE.
1 4 1. Notwithstanding section 34A.6, the board may request
1 5 imposition of a surcharge in an amount up to two dollars and
1 6 fifty cents per month on each telephone access line. The
1 7 board shall submit the question of the surcharge to voters in
1 8 the same manner as provided in section 34A.6. If approved,
1 9 the surcharge may be collected for a period of no more than
1 10 twenty-four months unless the period is extended as provided
1 11 in subsection 2. At the end of the twenty-four-month period,
1 12 the rate of the surcharge shall revert to one dollar per
1 13 month, per access line.
1 14 2. Notwithstanding the twenty-four-month limitation
1 15 imposed by the voters in subsection 1, at the end of the
1 16 initial period during which a surcharge of two dollars and
1 17 fifty cents per month per access line is imposed, the board,
1 18 upon a determination that insufficient funds are available to
1 19 the board to implement the E911 service plan, may extend the
1 20 period during which the two dollar and fifty cent surcharge is
1 21 to be imposed by a period of no more that twelve additional
1 22 months. The board shall only extend such period after
1 23 conducting a public hearing to allow for public comment on
1 24 such action.
1 25 EXPLANATION
1 26 This bill provides for the extension of the alternative
1 27 surcharge of $2.50 per month per access line for a period of
1 28 up to 12 months beyond the initial period during which such
1 29 surcharge was imposed. The extension can only occur after the
1 30 E911 board conducts a public hearing to allow for public
1 31 comment on the extension. Currently, the board may impose a
1 32 surcharge of $1 per month per access line, with the ability to
1 33 impose the alternative surcharge of $2.50 per month per access
1 34 line for a period of up to 24 months after approval by
1 35 referendum in the proposed E911 service area.
