1 1 Section 1. NEW SECTION. 476.58 TELEPHONE SOLICITATIONS
1 2 PROHIBITED – PENALTY.
1 3 1. A person shall not knowingly solicit another person at
1 4 that person's place of employment through the use of a
1 5 telephone or facsimile machine for the sale of goods or
1 6 services in this state, other than for the sale of goods or
1 7 services which are used by or related to the business of the
1 8 person's place of employment. A violation of this subsection
1 9 is a serious misdemeanor.
1 10 2. The board shall adopt rules implementing this section
1 11 and providing for the use of caller identification services
1 12 for determining the origin of a call which is in violation of
1 13 this section at no charge to the person receiving the call.
1 14 EXPLANATION
1 15 This bill prohibits the knowing solicitation of another
1 16 person at that person's place of employment through the use of
1 17 a telephone or facsimile machine for the sale of goods or
1 18 services in this state, other than for the sale of goods or
1 19 services which are used by or related to the business of the
1 20 person's place of employment. A violation of this subsection
1 21 is a serious misdemeanor. The utilities board is directed to
1 22 adopt rules providing for the use of caller identification
1 23 services for determining the origin of a call which is in
1 24 violation of this section at no charge to the person receiving
1 25 the call.
