  1  1    Section 1.  Section 174.9, unnumbered paragraph 1, Code
  1  2 1995, is amended to read as follows:
  1  3    Each eligible society which is a member of the association
  1  4 of Iowa fairs and which conducts a county fair shall be
  1  5 entitled to receive aid from the state if it files as provided
  1  6 in this chapter.  In order to be eligible for state aid, a
  1  7 society must file with the state fair board treasurer of state
  1  8 on or before November 1 of each year, a sworn statement which
  1  9 shall show:
  1 10    Sec. 2.  Section 174.9, subsection 4, Code 1995, is amended
  1 11 to read as follows:
  1 12    4.  A copy of the published financial statement published
  1 13 as required by law, together with proof of such publication
  1 14 and a certified statement showing an itemized list of premiums
  1 15 awarded, and such other information as the state fair board
  1 16 treasurer of state may require.
  1 17    Sec. 3.  Section 174.10, Code Supplement 1995, is amended
  1 18 to read as follows:
  1 19    1.  The appropriation which is made biennially for state
  1 20 aid to the foregoing societies shall be available and
  1 21 applicable to incorporated societies of a purely agricultural
  1 22 nature which were entitled to draw eight hundred fifty dollars
  1 23 or more state aid in 1926, or societies located in counties
  1 24 that have no other fair or agricultural society, and which
  1 25 were in existence and drew state aid in 1926, except that in a
  1 26 county where there are two definitely separate county
  1 27 extension offices, two agricultural societies may receive
  1 28 state aid.  The provisions of section 174.1 as to ownership of
  1 29 property shall not apply to societies under this section.
  1 30    2. 1.  In counties having two incorporated agricultural
  1 31 societies conducting county fairs, but not having two
  1 32 definitely separate county extension offices, the state aid
  1 33 shall be prorated between the two societies or, if There is
  1 34 appropriated from the general fund of the state for each
  1 35 fiscal year, the amount of four hundred ninety-five thousand
  2  1 dollars to the treasurer of state for purposes of providing
  2  2 state aid to eligible societies to support county fairs.
  2  3    2.  Each county shall receive an equal share of the moneys
  2  4 to support one or more societies conducting one or more county
  2  5 fairs in that county, if the society or societies are eligible
  2  6 for the state aid.  Moneys shall be paid directly to each
  2  7 eligible society.
  2  8    3.  The association of Iowa fairs shall provide the
  2  9 treasurer of state with a list of each society in a county
  2 10 which is a member of the association and conducts a fair in
  2 11 that county as provided in this chapter.  If a county has more
  2 12 than one fair, the association shall list the name of each
  2 13 society conducting a fair in that county for three or more
  2 14 years.  The treasurer of state shall not authorize payment of
  2 15 state aid to a society, unless the society complies with
  2 16 section 174.9 and the name of the society appears on the
  2 17 association's list.
  2 18    4.  If a county has more than one fair eligible for state
  2 19 aid, the amount of state aid for that county shall be divided
  2 20 equally among the eligible societies in that county.
  2 21    5.  If no society in a county qualifies to receive state
  2 22 aid, that county's share shall be divided equally among the
  2 23 counties with societies eligible for state aid, as provided in
  2 24 this section.
  2 25    6.  If an official county fair is designated by election,
  2 26 the total amount of state aid for that county shall be paid to
  2 27 that society determined to be conducting the official county
  2 28 fair.  The board of supervisors, upon receiving a petition
  2 29 which meets the requirements of section 331.306, shall submit
  2 30 to the registered voters of the county at the next general
  2 31 election following submission of the petition or at a special
  2 32 election if requested by the petitioners at no cost to the
  2 33 county, the question of which fair shall be designated as the
  2 34 official county fair.  Notice of the election shall be given
  2 35 as provided in section 49.53.  The fair receiving a majority
  3  1 of the votes cast on the question shall be designated the
  3  2 official county fair.  To qualify as the official county fair,
  3  3 the sponsoring society need not meet the conditions provided
  3  4 in subsection 1.
  3  5    Sec. 4.  Section 174.12, Code 1995, is amended to read as
  3  6 follows:
  3  7    174.12  PAYMENT OF STATE AID.
  3  8    The director department of revenue and finance shall issue
  3  9 a warrant to any a society for the amount due as in state aid,
  3 10 less one five hundred dollars, as provided the secretary of
  3 11 the state in this chapter.  The fair board certifies treasurer
  3 12 of state must certify to the director department that such the
  3 13 society has complied with the law relative thereto and that a
  3 14 named is eligible under this chapter to receive the amount is
  3 15 due the society provided in section 174.10.  The director
  3 16 department shall issue a like warrant to the society for one
  3 17 the remaining five hundred dollars, provided the if all of the
  3 18 following apply:
  3 19    1.  The secretary of the state fair board certifies to the
  3 20 department that such the society had an accredited delegate in
  3 21 attendance at the annual convention for the election of
  3 22 members of the state fair board as provided in section 173.2.
  3 23    2.  A district director of the association of Iowa fairs
  3 24 representing the district in which the county is located, and
  3 25 the director of the Iowa state fair board representing the
  3 26 congressional district in which the county is located, certify
  3 27 to the department that the society had an accredited delegate
  3 28 in attendance at the district meeting.
  3 29    Sec. 5.  Section 174.11, Code 1995, is repealed.  
  3 30                           EXPLANATION
  3 31    This bill amends a number of provisions in chapter 174,
  3 32 which relates to county and district fairs, and specifically
  3 33 provisions which provide for the appropriation and allocation
  3 34 of state aid to organizations referred to as societies which
  3 35 administer county fairs.
  4  1    Current law provides that state aid is authorized by the
  4  2 secretary of the state fair board and paid biennially to
  4  3 societies based upon a formula calculating premiums paid by
  4  4 county fairs.  The amount is limited to $2,000.  Current law
  4  5 also provides that the department of revenue and finance must
  4  6 pay $100 of the aid amount only after the department receives
  4  7 a certification by the secretary of the Iowa state fair board
  4  8 that the society has attended the annual state convention.
  4  9    This bill requires that a society be a member of the
  4 10 association of Iowa fairs.  It provides that the state
  4 11 treasurer is responsible for authorizing payment of state aid.
  4 12 The bill appropriates from the general fund of the state for
  4 13 each fiscal year, the amount of $495,000 to the state
  4 14 treasurer for purposes of allocating an equal share of state
  4 15 aid to each county.  The association of Iowa fairs must
  4 16 provide the state treasurer with a list of each society which
  4 17 is a member of the association and conducts a fair in that
  4 18 county.  If a county has more than one fair, the association
  4 19 must list the name of each society conducting a fair in that
  4 20 county for three or more years.  The amount of state aid for a
  4 21 county having more than one fair is prorated among the
  4 22 societies in that county which have conducted fairs in that
  4 23 county for three or more years.  If a county is not eligible
  4 24 to receive state aid, the bill requires that the county's
  4 25 share be divided equally among the counties with societies
  4 26 qualifying for state aid.  Finally, the bill increases the
  4 27 amount required to be paid to a society based on attendance at
  4 28 an annual convention and district meeting to $500.  In
  4 29 addition, the bill requires that a district director of the
  4 30 association of Iowa fairs and a director of the Iowa state
  4 31 fair board representing the county where the society is
  4 32 located must certify that the society attended a district
  4 33 meeting.
