  1  1    Section 1.  Section 331.302, subsections 7, 8, and 10, Code
  1  2 1995, are amended to read as follows:
  1  3    7.  A resolution becomes effective upon passage and an
  1  4 ordinance or amendment becomes a law when a summary of the
  1  5 ordinance or the complete text of the ordinance is published,
  1  6 unless a subsequent effective date is provided within the
  1  7 measure.  As used in this paragraph, "summary" shall mean a
  1  8 narrative description of the terms and conditions of an
  1  9 ordinance setting forth the main points of the ordinance in a
  1 10 manner calculated to inform the public in a clear and
  1 11 understandable manner the meaning of the ordinance and which
  1 12 shall provide the public with sufficient notice to conform to
  1 13 the desired conduct required by the ordinance.  The
  1 14 description shall include the title of the ordinance, an
  1 15 accurate and intelligible abstract or synopsis of the
  1 16 essential elements or the ordinance, a statement that the
  1 17 description is a summary, the location and the normal business
  1 18 hours of the office where the ordinance may be inspected, when
  1 19 the ordinance becomes effective, and the full text of any
  1 20 provisions imposing fines, penalties, forfeitures, fees, or
  1 21 taxes.  Legal descriptions of property set forth in ordinances
  1 22 shall be described in full, provided that maps or charts may
  1 23 be substituted for legal descriptions when they contain
  1 24 sufficient detail to clearly define the area with which the
  1 25 ordinance is concerned.  The narrative description shall be
  1 26 written in a clear and coherent manner and shall, to the
  1 27 extent possible, avoid the use of technical or legal terms not
  1 28 generally familiar to the public.  When necessary to use
  1 29 technical or legal terms not generally familiar to the public,
  1 30 the narrative description shall include definitions of those
  1 31 terms.
  1 32    8.  The auditor shall promptly record each measure, publish
  1 33 a summary of all ordinances or a complete text of the
  1 34 ordinances and amendments as provided in section 331.305,
  1 35 authenticate all measures except motions with signature and
  2  1 certification as to time and manner of publication, if any,
  2  2 and maintain for public use copies of all effective ordinances
  2  3 and codes.  A copy of the complete text of an ordinance or
  2  4 amendment shall also be available for distribution to the
  2  5 public at the office of the county auditor.  The auditor's
  2  6 certification is presumptive evidence of the facts stated
  2  7 therein.
  2  8    10.  The compensation paid to a newspaper for a publication
  2  9 required by this section shall not exceed three-fourths of the
  2 10 fee provided in section 618.11.  The compensation paid to a
  2 11 newspaper for publication of the complete text of an ordinance
  2 12 shall not exceed three-fourths of the fee provided in section
  2 13 618.11.
  2 14    Sec. 2.  Section 380.7, subsection 2, Code 1995, is amended
  2 15 to read as follows:
  2 16    2.  Publish a summary of all ordinances or the complete

  2 18 section 362.3.  As used in this paragraph, "summary" shall

  3  8    Sec. 3.  Section 380.9, Code 1995, is amended to read as
  3  9 follows:
  3 10    380.9  FEE FOR PUBLICATION.
  3 11    The compensation paid to a newspaper for any publication
  3 12 required by this chapter may not exceed three-fourths of the
  3 13 fee provided in section 618.11.  The compensation paid to a
  3 14 newspaper for publication of the complete text of an ordinance
  3 15 shall not exceed three-fourths of the fee provided in section
  3 16 618.11.
  3 17    Sec. 4.  Section 618.11, Code 1995, is amended to read as
  3 18 follows:
  3 19    618.11  FEES FOR PUBLICATION.
  3 20    The compensation, when not otherwise fixed, for the
  3 21 publication in a newspaper of any notice, order, citation, or
  3 22 other publication required or allowed by law, shall not exceed
  3 23 twenty-six cents for one insertion, and seventeen cents for
  3 24 each subsequent insertion, for each line of eight-point type
  3 25 two inches in length, or its equivalent shall be as
  3 26 established by the superintendent of printing, pursuant to
  3 27 chapter 17A, who shall annually review, and adjust when
  3 28 necessary, compensation rates to reflect changes in economic
  3 29 conditions within the newspaper industry and the general
  3 30 economy of the state.  Publication of matter which may be
  3 31 photographically reproduced for printing instead of typeset
  3 32 shall be compensated at a rate not to exceed the lowest
  3 33 available earned rate for any similar advertising matter.
  3 34 Statements of itemized financial and other like columnar
  3 35 matter shall be published in tabular form without additional
  4  1 compensation.  In case of controversy or doubt regarding
  4  2 measurements, style, manner, or form, the controversy shall be
  4  3 referred to the executive council, and its decision is final.
  4  4 Prior to establishing or adjusting any rate the superintendent
  4  5 of printing shall consult with representatives of the daily
  4  6 and weekly newspaper industry and with representatives of
  4  7 affected units of local government.
