1 1 Section 1. NEW SECTION. 306C.3A RECORDS TO BE MAINTAINED
1 2 BY JUNKYARD OPERATOR.
1 3 1. A person who establishes, operates, or maintains a
1 4 junkyard in this state, and who purchases junk from another
1 5 person, shall maintain a record of the transaction and issue a
1 6 bill of sale signed by the seller. A bill of sale must be
1 7 evidenced in duplicate and shall include all of the following:
1 8 a. Date of sale.
1 9 b. Description of the item purchased.
1 10 c. Amount paid for the item.
1 11 d. Name of the junkyard operator.
1 12 e. Signature of the seller.
1 13 f. Address of the seller.
1 14 2. The records shall be made available to a law
1 15 enforcement agency or official for inspection at reasonable
1 16 times, with or without notice.
1 17 EXPLANATION
1 18 This bill requires a person operating a junkyard who
1 19 purchases junk from another person to maintain a record of the
1 20 transaction and issue a bill of sale signed by the seller. A
1 21 bill of sale must be evidenced in duplicate and is to include
1 22 the date of sale, description of the item purchased, amount
1 23 paid for the item, name of the junkyard operator, signature of
1 24 the seller, and address of the seller. The records are to be
1 25 made available to law enforcement for inspection at reasonable
1 26 times, with or without notice.
1 27 For purposes of chapter 306C, "junk" is defined as old or
1 28 scrap copper, brass, rope, rags, batteries, paper, trash,
1 29 rubber debris, waste, or junked, dismantled, or wrecked
1 30 automobiles, or parts of automobiles, or iron, steel, or other
1 31 old or scrap ferrous or nonferrous material.
