PAG LIN 1 1 Section 1. Section 249.3, subsection 2, paragraph c, Code 1 2 1995, is amended to read as follows: 1 3 c. Does not have sufficient income to meet the cost of 1 4 care in one of the living arrangements defined in paragraph 1 5 "a"of this subsection, which cost of care shall not exceed 1 6 the amount established by the rules of the department for each 1 7 of those living arrangements. The rules shall provide that in 1 8 determining the cost of care and the net income eligibility of 1 9 a resident of a residential care facility, the net income 1 10 guidelines used in determining eligibility for a resident of a 1 11 nursing facility shall be used. The maximum cost 1 12 reimbursement rate established for residential care facilities 1 13 reimbursed by the department shall reflect the cost of care 1 14 established pursuant to this paragraph. 1 15 EXPLANATION 1 16 This bill provides that in adopting rules regarding 1 17 determination of the net income eligibility and the cost of 1 18 care of a resident of a residential care facility, the 1 19 department of human services is to use the income guidelines 1 20 for a resident of a nursing facility. The bill also provides 1 21 that the maximum cost reimbursement rate established for 1 22 residential care facilities reimbursed by the department is to 1 23 reflect the cost of care established under the bill. 1 24 LSB 3517HH 76 1 25 pf/jw/5
