PAG LIN 1 1 Section 1. Section 476.42, subsection 3, Code 1995, is 1 2 amended by striking the subsection. 1 3 Sec. 2. Section 476.43, Code 1995, is amended by striking 1 4 the section and inserting in lieu thereof the following: 1 5 476.43 ALTERNATE ENERGY PURCHASE. 1 6 An electric utility shall purchase any energy which is made 1 7 available from an alternate energy production facility or 1 8 small hydro facility at a rate which does not exceed the 1 9 avoided costs to the electric utility of the alternate energy 1 10 purchase. For purposes of this section "avoided costs" means 1 11 the incremental costs to an electric utility of electric 1 12 energy, capacity, or both, which, but for the purchase from 1 13 the alternate energy production facility or small hydro 1 14 facility, the electric utility would generate itself or 1 15 purchase from another source. 1 16 Sec. 3. Section 476.44, subsection 2, Code 1995, is 1 17 amended by striking the subsection. 1 18 Sec. 4. APPLICABILITY TO EXISTING CONTRACTS. This Act 1 19 shall not affect a contract between an alternate energy 1 20 production facility or small hydro facility and an electric 1 21 utility that was entered into pursuant to sections 476.43 and 1 22 476.44 for purchase of alternate energy if the contract was 1 23 entered into prior to the effective date of this Act. 1 24 Sec. 5. CONDITIONAL REPEAL. In the event that the federal 1 25 requirements for purchase of alternate energy contained in 16 1 26 U.S.C. } 824a-3 are repealed, section 476.43 is repealed. 1 27 Sec. 6. EFFECTIVE DATE. This Act, being deemed of 1 28 immediate importance, takes effect upon enactment. 1 29 EXPLANATION 1 30 This bill repeals current alternate energy purchasing 1 31 requirements and instead requires that an electric utility 1 32 purchase any energy which is made available from an alternate 1 33 energy production facility or small hydro facility at a rate 1 34 which does not exceed the avoided costs to the electric 1 35 utility of the alternate energy purchase. For purposes of 2 1 this section "avoided costs" means the incremental costs to 2 2 the electric utility of the electric energy, capacity, or 2 3 both, which, but for the purchase from the alternate energy 2 4 production facility or small hydro facility, the electric 2 5 utility would have generated or purchased from another source. 2 6 Current law requires each of the investor-owned electric 2 7 utilities to purchase a portion of their 105-megawatt share of 2 8 alternate energy at a rate determined by the Iowa utilities 2 9 board. 2 10 The bill provides that repeal of the current alternate 2 11 energy purchasing requirements does not affect a contract 2 12 between an alternate energy production facility or small hydro 2 13 facility and an electric utility that was entered into prior 2 14 to the repeal of those requirements. The bill makes several 2 15 conforming changes. 2 16 The bill provides that in the event the federal government 2 17 repeals their alternate energy purchasing requirements, the 2 18 requirements of this Act shall be repealed. 2 19 The bill is effective upon enactment. 2 20 LSB 3537HH 76 2 21 js/cf/24
